This Court has the rule that the case must first go through all instances of the national legal system. But then, it is very effective. For example, there was a Hungarian businessman who was arrested when going on holiday to Austria on an arrest warrant from Italy. He was sentenced to a long prison term on all instances for having been an arms trafficker supplying a bank robber ring in Italy. But the case against him was based on nothing, he was not informed of having been indicted, and his rights were trampled on during the trials. Lot to sweep under the carpet. But Strasbourg freed him.

Unfortunately Strasbourg might not be able to free him if he is already locked in a cell in USA.
