4 of those are conservatives who I believe will vote to overturn: Roberts, Scalia, Thomas, Alito. 1 is a swing vote: Kennedy. 1 is an Obama nominee: Sotomayor.
If the Supreme Court agrees to hear this case and if they overturn Reinhardt's ruling, I think it effectively signals a theocracy.
I'm excited and nervous about this -- the former because I've read many of Kennedy's opinions (he seems to lean strongly the right way here), and the latter because obviously the stakes are very high and I'd hate to be wrong. Given the grounds on which the Ninth ruled here, SCOTUS probably has little choice but to finally make a decision here.
