What I was after though was whether or not the phrase "notion victim" is a legal term of art, phrase which has a particular meaning that conveys legal status or consequences. (Recall how I was tracking application of "limited-purpose public figure", for example).
I'm 99% certain that it's not. And I won't argue the supposition, Avenatti is exploiting the gullibility of reporters and a sensational, salacious event to sample unsolicited, #bullshit "expertise" he's waving at IL prosecutors. To be charitable, I started my inquiry with only the "presumption of innocence": Until any crime is determined, the factual identity of any victim is moot ("notion [of] victim").
Kelly's charges are criminal -- seen the prosecution's charge brief online. The state is the complainant -- not Avenatti's two anonymous clients qua his "notion victims" who doubtless seek tort relief ($ penalty) with or without offering witness testimony at criminal trial. The only other attys involved are Kelly's defense. Avenatti coaches his clients (and press) as if prospective witness for prosecution. Avenatti wants to see a big "pay off", because that's his business.
I did my own innerboob research overnight. I wont bore you all with it. I will say this, I had no idea that Victimology --which complements Criminology--has become a "high-growth" academic disciple (in sociology) and commercial career path in just the past 25 years or so. Diversity is the key to economic and political evolution.
So, Avenatti invents a new class of non-victim to create a sense of unguilt keep to the Fen Causeway
