whitehouse.gov | Press Briefing by Press Secretary Karine Jean-Pierre and National Security Advisor Jake Sullivan, 13 May 10-point Global Enduring Calm Normalization Plan
SULLIVAN: Nine, we are urgently and relentlessly working for a ceasefire and a hostage deal, starting with the first phase and building to an enduring calm. As the President said this weekend, there could be a ceasefire tomorrow if Hamas simply released women, wounded, and elderly hostages—all innocents.

Israel put a forward-leaning proposal on the table for a ceasefire "fighting pause" and hostage deal. The world should be calling on Hamas to come back to the table and accept a deal. The hostages include [Palestinian-]Americans [?] and citizens from around the world. The President is determined to bring them safe—safely back to their loved ones. And I met with the families of these American hostages again just this past Friday [10 May?].

The families of American-Israeli hostages in Gaza met with US National Security adviser Jake Sullivan on Monday [6 May] in Washington to press for their immediate release, according to the Hostages Families Forum Headquarters. The forum says at least eight American-Israelis were taken hostage by Hamas. Five of them are still thought to be held alive in Gaza. Another, 19-year-old Itay Chen, was confirmed dead by the Israel Defense Forces last month.

QUESTION: Okay. Second question, in addition to everybody else asked, is you said that Israel is not a member of the ICC, which is true. But also, and I don't know if you're aware of this or not, but Israel has supported the candidacy of Mr. Khan when he was elected in 2021, and they wanted him to be there. So, the fact that they actually endorsed him, they know there are some consequences, otherwise they won't have bothered in the first place. So, this is just to—I don't agree—to agree or disagree.
MILLER: It doesn't change the underlying—
QUESTION: It doesn't change anything.
MILLER:—the underlying jurisdictional question.
Rome Statute of the ICC, Part 2, Jurisdiction, Admissibility, and Applicable Law
QUESTION: Okay. So that my question is lawmakers agreed with you. They said the same. They repeated the same statement they issued in the White House. But they went further, and they said actually the decision is antisemitic. Do you agree that this decision is antisemitic as well?
MILLER: That's not an assessment that we have made or a conclusion we have drawn.
archive "Report to Congress under Section 2 of the National Security Memorandum on Safeguards and Accountability with Respect to Transferred Defense Articles and Defense Services (NSM-20)," 10 May  pp 18-32
QUESTION: Okay, and one last thing is on the issue itself, many international lawyers, very well known, different background, they said they found a reasonable ground that actually Israel has committed crime against humanity and crimes—war crimes. Does the White—Sorry, the State Department lawyers have a different conclusion, or did the—you have not reached this conclusion, or do you disagree with them? What exactly the difference between the lawyers who works at State Department and international lawyers who found different conclusion?
MILLER: So let me try to separate the ICC and answer this in two ways. One, when it comes to the ICC, we have a jurisdictional issue and then we have an issue with how this investigation was conducted. But to answer your underlying question about making that sort of determination, it is a question that we are looking at here. We have ongoing processes to look at Israel's use of U.S.-provided weapons, and those processes are ongoing. We have not yet reached final determinations.

AMANPOUR: The world 'genocide' has been used by both sides, and many believe that genocide is being committed. But you do not. You're not using that word.
KHAN: Well, this is an active investigation, and we have criminal charges that we can use—genocide, war crimes, and crimes against humanity in relation to this current stage of investigations. The charges that we've but forward to the judges do not include genocide, but we are continuing to investigate. It's a very complex situation. We have not been allowed access into Gaza by the Israeli authorities. We are aslo continuing our investigations in relation to the Hamas attacks. And i and when the evidence points us in a particular direction, we will not hesitate to act. So it's still an active investigation. But, yes, we haven't.
AMANPOUR: What is extermination?
KHAN: It's mass killing.
AMANPOUR: Different than genocide?
KHAN: Yes. Genocide is defined by specific intent, not only killing, but an intention to destroy the group in whole or in part with specific intent to destroy the group in whole or in part. So we're not, we've not incuded in out application today warrants for the crime of genocide
m'k. War is genocide. BUT. What are the odds that charge obtains convictions of the Shoah's poster boys, compared to stateless Hamas' rape murderers?

AMANPOUR: Recently, when word cam out that this may be happening at some point, US senators and US Congress people, mostly Republicans, wrote you a letter, signed by Senator Tom Cotton, Mitch McConnell, Ted Cruz, Marco Rubio, and others. If you move forward with the measures indicated in the report, we will move to end all American support for the ICC, sanction your employees and associeates, and bar you and your families from the United States. You have been warned.' Is that a threat?
KHAN: I think, that's the plain meaning of it in English.... And I've said to distinguished members on the Hill and to the administration that Rome Statute values are quintessential American values.... Now, of course, this situation, unfortunately, lies on the San Andreas fault of international politics, and strategic interests and, of course, I've had some elected leaders speak to me and, you know, be very blunt. 'This court is built for Africa and for thugs like Putin' was what one senior leader told me.

The United Nation is the established Word Order post WWII and the ICJ and ICC are a major supporting part of it. America from many recent presidents and administrations set policy to undermine International Law and Humanitarian Law. The U.S.-UK and Israel will forever be considered rogue states for what has taken place over decades in the Middle East and the genocide of Palestinian people. This will be a stain on the Jewish State of Israel forever and make much of the Holocaust rhetoric moot.

Netanyahu case will make or break the ICC

A longtime ICC skeptic, O'Connell is worried Khan's action will "cause more harm than good," prolonging the conflicts raging in the Levant and Eastern Europe, as the indictments will undoubtedly complicate peace negotiations. "It pushes us away from the viability of talks and peace agreements and settlements. Therefore, we will have far more loss of life in this effort to hold a few individuals accountable, which, in the view of many of us in the international law realm, has never really succeeded," she told POLITICO.

The indictments will end the air of impunity for Israel and its leaders ... the indictments cannot be brushed over by an UK white-wash commission.

Of the 34,735 people who have died in Gaza since the war began, according to data published May 6 by the UN, more than 9,500 were women and more than 14,500 were children. UN seemingly halves estimate of Gazan women, children killed | JPost - 11 May 2024 |

The UN  also highlighted that the plurality of identified fatalities were men (40%), while children were (32%) and women (20%).

The Washington Institute for Near East Policy (WINEP) released a report in January that showed major discrepancies in the fatality reports. The research concluded that such discrepancies were most likely caused by manipulation.

Professor Abraham Wyner showed that the Hamas-controlled Gaza Health Ministry has been "faking" casualty numbers, in an article for Tablet Magazine on March 7.

He concluded that in war, the pattern of deaths should be irregular as the intensity of war is irregular. the UN reported that the number of deaths climbed by 15%, which is statistically impossible.

Deteriorating Efforts as the Battle Progressed

The October 27 expansion of fighting to include ground operations inside the Gaza Strip has rendered the normal reporting system entirely ineffective. Whatever the accuracy of Health Ministry fatality figures in past conflicts, the current war is vastly different in scale, having seen the internal displacement of perhaps 1.7 million Palestinians. It is also the first Gaza conflict to involve severe and repeated loss of communications, combined with closure and evacuation of hospitals and an all-out IDF ground operation.

The loss of hospital capacity is borne out by the numbers. Six weeks after the start of ground operations, only eighteen of thirty-six hospitals in Gaza remained operational, and only a few in the north were even partially functional. Under such circumstances, many injured or dead Gazans are not brought to the hospital, where they would be formally counted. Moreover, ambulances often lack fuel or simply cannot reach war zone areas. As the battle has progressed, reports have proliferated of mass burials of unidentified Gazans, whose deaths may be unreported to the Health Ministry. This suggests a likely undercount of total deaths, as often occurs in confusing urban battles--although some no-longer-missing or rescued persons will not have been removed from lists of the presumed dead.

Israeli Intelligence Has Deemed Hamas-Run Health Ministry's Death Toll Figures Generally Accurate | VICE - 25 Jan 2024 |

Israeli intelligence services have studied civilian casualty figures released by the Hamas-run Ministry of Health in Gaza and concluded the figures were generally accurate, despite earlier public claims by U.S. and Israeli officials that the ministry's statistics are manipulated.

According to a story in Mekomit by Yuval Avraham, who last year broke news about the Israeli military's use of AI for targeting purposes, the numbers were accepted for inclusion in briefings to senior Israeli officials after intelligence services conducted operations and analysis to monitor the health ministry's information collection methods and its internal communications and determined the statistics were credible.

It was not the first time Israelis have blocked aid access to Palestinians at checkpoints and border crossings since the latest war on Gaza began in October. This latest example occurred at the Tarqumiya checkpoint west of Hebron in the Occupied West Bank. Once again, soldiers stood by and watched. President Michael D Higgins denounced the incident at the Tarqumiya checkpoint in a statement issued today, in which he also condemned the Israeli targeting of aid convoys in Gaza.

On Thursday night, a truck believed to be carrying aid to Gaza was stopped on a West Bank highway and set on fire by far-right Israeli protesters. Three Israeli soldiers were injured while attempting to provide medical care to the driver and disperse people, said the Israeli military. Israeli media reported that it was at least the fourth such attack on a Gaza aid convoy crossing Israeli territory from Jordan or the West Bank since late last week.

Far-right Israeli finance minister Bezalel Smotrich wrote to Prime Minister Benjamin Netanyahu on Thursday, demanding "clarifications" about aid being supplied directly from the West Bank and Israel for Gaza. He claimed the supply of aid via this route violated previous cabinet decisions.

"We must defeat Hamas—renewing trade with Gaza is not the way," Smotrich wrote.

He said the Nigerien leaders took particular umbrage at remarks by Molly Phee, the State Department's top official for African affairs, who he said had urged the government during a March visit to Niamey to refrain from engaging with Iran and Russia in ways objectionable to Washington if Niger wanted to continue its security relationship with the United States. With one hand, Macron immobilised execution of a constitutional "reform" passed from seats of the metropol National Assembly to the overseas provincial parliament. wilsoncenter | The Squad and the Quad, 14 May INDOPACOM "latticework"
In recent weeks, a new minilateral in the Indo-Pacific has emerged: the "Squad," as it is dubbed informally in the Pentagon. The new grouping of Australia, Japan, the Philippines, and the United States coalesced during a Defense Ministers' meeting in Hawaii in May 2024, following up on a previous gathering at the 2023 Shangri-La security dialogue. With its traditional security focus, the Squad adds another layer to the developing latticework architecture in the Indo-Pacific. But does it mean that the old Australia-India-Japan-US Quad is obsolete?
Unlike the original Quad, the Squad is about traditional hard power security, hence the "S" appended to its name. The meeting readout makes this abundantly clear, directly naming the People's Republic of China as the aggressor in the East and South China Seas. This meeting builds on several years of effort and defense cooperation between all four powers, including joint naval patrols in the South China Sea. Its hard power security emphasis and the addition of the Philippines instead of India distinguish Squad from Quad.
defense.gov | Joint Readout From Australia-Japan-Philippines-United States Defense Ministers' Meeting (03.05.24)
