Chinese Tech Giant Huawei Fires Sales Director Accused By Poland Of Espionage | Huff Post - Jan 13, 2019 |

The Chinese tech company Huawei announced it has fired a sales director who was arrested in Poland and charged with spying for China, saying he has brought the firm's reputation "into disrepute."

The company said it has "decided to terminate the employment of Mr. Wang Weijing, who was arrested on suspicion of breaking Polish law."

Polish authorities said Friday they have arrested Wang, a Chinese citizen and former diplomat, along with a Polish cybersecurity expert who had held several top government cybersecurity jobs and also worked at the telecom company Orange.

Huawei said Wang's actions "have no relation to the company" and that he was fired because "the incident in question has brought Huawei into disrepute."

I discovered last night that someone innerboob correspondent asked the question, Why is Theresa May still PM?

This correspondent was unwilling or unable to join 325 MPs, elected by UK citizens to represent their will, to the result of the confidence vote, performed according to procedures of UK law.

Conversely, the same was unwilling or unable to join 315 MPs excluding DUP partisans, elected by UK citizens, to the result of the confidence vote.

Instead, the same postulated the preternatural fear of The Establishment prevented election of alternative candidates.

It's Not a Government Shutdown. It's a Right-Wing Coup. | The Nation
Just as they did in October of 2013, the media is uniformly calling the selective starving of government by Republicans in Congress a "government shutdown." It is anything but. The term "government shutdown" gives the public the false impression that the entire government is being shut down, when in reality, only a small percentage of the government gets shut down--and for starkly ideological reasons.

What we are really facing is a liberal government shutdown--which is to say programs designed to help the vulnerable and poor are gutted, while institutions designed to serve the rich and powerful remain unscathed.

World renowned images of palms, temperate climate, "liberal" lifestyle, and Democratic Party domination of the legislature and electoral processes have long over-shadowed the state's attraction to Republican governors, economic discrimination by race and ethnicity, and brutal penal law enforced by "top cops" (AGs). This early phase of interaction with my children came to an abrupt halt in 1972 when, after a hard-fought custody battle in the family court of Oakland, California, the context of the relationship was placed within arbitrary limits imposed by a court-ordered divorce settlement based on the false assumption by the State of California that fathers cannot handle parenting (especially in the case of this father, "a neegroe from da eyelans" was the Yankee stereotype, who might just end up eating his children for breakfast!).  Nevertheless, I persisted, never giving up on my love for my children or reneging on my responsibilities as their father.

"The attempts by the Trump administration to mandate a question about citizenship were not rooted in a desire to strengthen the census process and would only undermine our immigrant communities," James said in a statement. "Inciting fear in our residents is not only immoral, but also ill-conceived. Accurate population counts are imperative for allocating funding for critical programs and support systems and for determining fair representation in Congress and the Electoral College."

< squint >
The ruling was not a wholesale victory: though the lawsuit charged violations of the Constitution's enumeration clause and Fifth Amendment rights to equal protection, Judge Furman stopped short Tuesday of finding constitutional violations.

BULLETIN: High Court Asked to Back Off Deposition Spat in Census Case
(reads like a US House Speaker [Art. I] wanting to boss the SCOTUS [Art. III], eh?)

yeah, no. Here is a timely reminder of the US appellate process, legal strategy, and controversial "challenges" to Article I, II, III powers --taken together, a "constitutional crisis" in waiting.

[Art. II] and [NY State, et al., Art. I as amended] told the Supreme Court [Art. III] late Thursday to cancel its upcoming hearing on case.

The Supreme Court had agreed back in November to consider whether Commerce Secretary Wilbur Ross should be [COMPELLED] to testify [by district court Judge FURMAN] about why he added the question.

At the time [SCOTUS] took up the [RESPONDENT'S PETITION FOR writ of certiorari]

Error? Inferior court judgment compelling Ross testimony questioned
" 'The court may reopen the trial record for the purpose of obtaining and including Secretary Ross's testimony in the event that the Supreme Court's stay of this court's order compelling that testimony is dissolved before the court issues a final decision,' Furman's 2-page order today states."
[US DISTRICT COURT JUDGE] Furman did not [adjudicate NY State, et al] constitutional questions
[...]
[DOJ] filed a notice of appeal in the New York case on Thursday as well, setting the stage for Furman's ruling to go to the Second Circuit [APPELLATE REVIEW].

With the survey's printing deadline in June 2019, a federal judge in California is weighing a separate challenge to the citizenship question.

Long story shorter: for the moment, SCOTUS intervention is out of scope; NY State, et al. and US will rehearse their arguments on the merits decided by Furman; and delay on appeal will probably obviate printing of Teh Dread 2020 Census Question in timely manner. Yeah! for ineligible voters of the USA!

Unless SCOTUS intervenes.

Pelosi asks Trump to postpone State of the Union address because of government shutdown -- or deliver it in writing
The State of the Union is off," [MD-5 Rep. Steny] Hoyer said during a CNN interview.

Aides later said he had misspoken.

"Mr. Hoyer had not read Speaker Pelosi's letter and mischaracterized it," Hoyer spokeswoman Katie Grant said.

letter to Trump, facsimile, in lieu of impeachment proceeding ... to removal from office.

The House planned another vote Wednesday to reopen the government without funding Trump's wall, this time on a stopgap spending bill through Feb. 8.

Senate Majority Leader Mitch McConnell (R-Ky.) once again rejected this tactic in a Senate floor speech Wednesday, saying: "As the White House has made clear just yesterday, cherry-picking continuing resolutions that fail to address the border security crisis are not going to receive the president's signature. Not going to. The only way out of this impasse is a bipartisan agreement."

Do the facts need repeating? Congress cannot enact any bill without passage by both chambers.

House Republicans call for moving State of the Union to Senate chamber
Joint sessions and meetings of Congress have typically taken place in the House chamber since 1809. But according to the Senate historian's office, presidents have delivered addresses in the Senate chamber before, including Presidents Ford, Nixon, Truman and Hoover.
Beats potential embarrassment of DCCC boycott of the SOTU in the House chamber, if so ordered by the speaker. I never watch 'em myself. I prefer transcript viz. prepared remarks
When asked what would happen if Trump insists on delivering the address on the originally planned date of Jan. 29, Pelosi said Thursday: "We'll cross that bridge when we come to it."

Federal judicial structure, descending order of review; here is a counter-intuitive presentation, because the appeals process begins at the end of this list and concludes at the top of the list, the SCOTUS.

US district court judge JEAN does nothing but issue an opinion and ruling (orders) on the dispute "in the first instance".

The adversely affected litigant might appeal JEAN's ruling to the superior court ("higher", appellate), ie. petition to review, JEAN's questionable judgment.

archived comparing

... In a sense, the SCOTUS preserves state sovereignty and "democratic values" by instituting and respecting the appellate review processes; litigation "bubbles up" to the writ of last resort. ...

Historically, it is not unusual for either (active or inactive) litigants or judges to discriminate between claims suitable for review by the appellate process, when the goal of *litigants is definitively to alter some class of case law.

Criteria of selection typically addresses the merits of the claim, findings of fact and law represented by the claim, sufficient to warrant review and a substantitive opinion either to reverse or hold current case law, if not one or more governing statutes.

Thus, a *litigant will choose to proceed (or not) to trial, if the merits of a "test case" are like to prevail in favor of the litigant, ie. reveal some error in adjudication.

Thus, a judge will choose to accept (or not) review of a claim; or deliberately issue a controversial ruling on a point of law in order to provoke a litigant to appeal.

The latter strategy (mine) is based on observations and rather unorthodox, as one is unlikely to find corroboration from officers of the court who are living, easily.

The latter strategy is the only charitable explanation for JEAN's narrow ruling, in my opinion.

"I concur in the denial of the petition for a writ of certiorari because denial of certiorari does not signify that the court necessarily agrees with the decision (much less the opinion) below," he wrote. Pearce also said courts are still using detention to keep kids in danger of hurting themselves, running away or being trafficked in a safe and secure place. She said doing so takes a "paternalistic view of kids" that keeps them safe in the short term but doesn't address long-term issues.

"Putting them in detention for 10 days keeps them safe for 10 days. It is convenient but doesn't address the risk that kid faces," Pearce said.

Since 2017, Beijing, Shanghai and other big cities have forced out migrant workers who lack official permission to live there. Local leaders say they want to reduce crowding, but restaurants, retailers and other companies depend on migrants as employees and increasingly as customers.
The more prosaic story behind this 'boom-bust' detail, my associate informed me, is the hukou system controls in PRC industrial policy (est'd 1951). 'Human rights' and labor economists have noted that "privatization" of market-based incentives have undermined social mobility and economic integration of low- and high-skill work force ("rural-urban" income inequalities). The Beijing Olympic potemkin was a lurid example of party-elites' prerogative to dispossess property-owners and migrant tenants by abusing hukou.

The Russian GPS system satellites orbit at higher angles, so their accuracy is better than the American GPS system when you're in the Arctic. Which starts to matter when the Arctic Ocean is a navigable seaway for trade, resource exploitation, and warships.

Not that you'll get the Australian govt to cre. Quietly, and with little fuss, the govt there has become the GOP's wettest dream of environmental, social and economic destruction.

Welcome "post-partum psychosis" to the First World, as seen on the internet.
She Wanted To Be The Perfect Mom, Then Landed In A Psychiatric Unit
"The work that we do here is less than 10 percent of what needs to be done," says Dr. Nirmaljit Dhami, a psychiatrist at El Camino Hospital in Mountain View, Calif. She helped review the [CA state study of maternal] suicides but did not share data from the report with journalists.
[...]
That means that some U.S. doctors may start their patients on new drugs but not have time to see if they work well. Or they have to start women on the most intense medications right away -- medications that force her to stop breastfeeding -- instead of slower-acting therapies that could allow a mother more time to feed her infant breast milk.
[...]
The psychosis did not come back after Vivian's birth, in part because of all the ["]precautions["] Lisa took. She made sure she got enough sleep. She gave herself permission to give up breastfeeding if it became too much.

The project is supported by funding from Merck, through an award agreement with its Merck for Mothers program. ...The goal of Review to Action is to promote the state-based maternal mortality review process as the gold standard for maternal mortality surveillance and intervening in pregnancy-related death. Lest year, Liz Lochhead kickit up a stooshie by statin Burns wis a "Weinsteinian sex pest". She referenced, as ithers the likes o biographer Robert Crawford or journalist Stuart Kelly hae duin, a boastfu letter Burns wrote aboot a sexual conquest o Jean Armour. It's no a richt admíssion o rape, or assault - Jean's feelins is hid ahint the locker-ruim braggart wha claims he "f*cked her until she rejoiced". It's certes no the straicht clarity o Samuel Pepys wha wis constantly rapin wímmin (Exhibit A: his diary December 20 1664).

Fir me, the Weinsteinian Burns is maist appairent in his habit o gettin servant lassies pregnant. It's certes important tae the "Burns Community" that he wis irresistible, an aw the lassies wantit him, but if the #MeToo movement has lairnt us onyhin, it's that pooer structures are invísible tae them that's in pooer, an een Nice Guys abuse thae structures wioot seein theirsels as monsters. Ye cannae hae a relationship wi an employee, wha lives an sleeps unner yer command, wha's future ye haud in the palm o yer haund, wioot riskin abuse.

In layman's words, the message is the Duke was involved in a car accident but walked away unscathed. The Archbishop has no prayers for the people in the other vehicle of the crash, no best wishes/prayers for a future journey to the heavenly gates?
