COURTHOUSE NEWS | Google Sways Magistrate on Limiting Right to Be Forgotten
"This is all the more so since such a public interest in accessing information will necessarily vary from one third state to another depending on its geographic location. There would be a risk, if worldwide de-referencing were possible, that persons in third states would be prevented from accessing information and, in turn, that third states would prevent persons in the EU member states from accessing information. "

This was the assessment in a report released Thursday by the European Court of Auditors, an EU body that acts like a government accountability office in the United States.
[...]
It noted that about 45 percent of anti-fraud probes result in the prosecution of suspected fraudsters. It said that on average OLAF recommends 17 cases annually for prosecution to national prosecutors, but fewer than half of those cases have led to the prosecution of suspected fraudsters, the audit said.

UK police advise shops to hire extra security for no-deal Brexit
LONDON -- U.K. police are advising retailers to consider hiring extra security guards in the event of a no-deal Brexit, amid fears that public concern about potential shortages of food and other goods could lead to crowd control issues at shops.

Contingency planners are concerned supermarkets and other retailers may have to deal with a rush of customers if fears of shortages leads to panic-buying. However, in a statement, a spokesperson for London's Metropolitan Police said they have no information to suggest that looting is a likely outcome of a no-deal Brexit.

British MEPs to bag lucrative post-Brexit payout
British MEPs departing the European Parliament because of Brexit will receive a payout worth tens or even hundreds of thousands of euros.

According to a 22-page document obtained by POLITICO titled "British Members end of mandate," the British legislators who are due to leave on March 29 can claim a "transitional allowance" of €8,611.31 per month before tax for up to two years, depending on their length of service.

The financial package offered to Brexiting MEPs is no different from that offered to any other EU legislator leaving the assembly, for example if they are voted out. MEPs are entitled to a month of transitional allowance (the same amount as their salary) for every year they have been in the Parliament. So Brexit champions Nigel Farage and Daniel Hannan, who both began their mandates in 1999, will be entitled to over €172,000 in transitional payments if they do not take on another public or parliamentary appointment in the 20 months after Brexit day.

Almost certainly, yes.

So can they stop the government leaving without a deal?

There is no clear legal route available to them to stop a no-deal Brexit.

Are there other ways for rebels to stop a no-deal Brexit?

Yes, but they are political, rather than legal avenues.

It's how UK govt "works", only the Govt, ie the Cabinet and the whips (effectively Theresa May), can schedule debates to change the law.

We are nominally a democracy, but the Government rules in loco regina, ie more or less nothing can happen without the say so of the Govt. So getting a chnge that the govt disagrees with is immensely difficult and requires a lot more than a mre majority of back bench MPs to make happen. This is why the speaker's intervention last week was so important. He may have made a major change to the Constitution, but nobody is really sure.

The US impeachment/conviction system has not actually been tested yet. There have been several impeachments in the house, but no convictions in the senate. A determined president might find various justifications in the convoluted 18th Century language of the Constitution to try to maintain power.

John Dowd, Trump's lawyer, has claimed that the president by definition cannot obstruct justice, because he is the chief law enforcement officer. Based on that argument, if the president says the impeachment and conviction were unconstitutional or were not performed correctly, he is not required to comply.

Articles of the US Constitution distribute authority to ahh rule among the political bodies of the federal gov't. The text is not convoluted. It is a list. It contains punctuation marks.

To the contrary one might confidently state, these provisions listed are definitive, or more fancifully infinitive, forms of acts. The early "modern" libertines intended this code, those authorities, to be performative, or "actualized," in the language of late modern mystics; to be "interpreted" by WHOM? without benefit of musical accompany.

The correct answer, regardless of Dowd's argument, is neither Congress nor the POTUS.

The Articles establish a few executive agents by name. These and all the rest have been created (established) and defined (vested, codified) by legislative acts in subsequent sessions of the US Congress in the English coin of the day. One may find the records --committed by the clerks of each chamber-- in physical and digital volumes of the FEDERAL REGISTER and NATIONAL ARCHIVE, if one searches, then reads and comprehends the ahh litchichure.

Statutory definitions by the US Congress very often explicitly delegate authorities to the office of POTUS and its agents (agencies: offices of agents) in order to execute (implement, regulate, direct, enforce, instiate, effect) congressional acts. A surprising amount of that cumulative work product is defective for the simple reason one provision ahhh chained to another contradicts itself. In USA detecting, not interpreting, these (=>) errors is a profession shared by lawyers, comedians, taxpayers, widows, orphans, and religious extremists.

I for one do not long for the day I awake find President Harris, Pence, or whoever from HELL, directing AG Wm. Barr on how to enforce USC --because the last session of Congress forbade the POTUS terminating the commission of any officer of the executive without the permission of a House of odious.

Manafort Accused of Sharing Trump Polling Data With Russian Associate - NYT

As a top official in President Trump's campaign, Paul Manafort shared political polling data with a business associate tied to Russian intelligence, according to a court filing unsealed on Tuesday. The document provided the clearest evidence to date that the Trump campaign may have tried to coordinate with Russians during the 2016 presidential race.

Mr. Manafort's lawyers made the disclosure by accident, through a formatting error in a document filed to respond to charges that he had lied to prosecutors working for the special counsel, Robert S. Mueller III, after agreeing to cooperate with their investigation into Russian interference in the election.

The document also revealed that during the campaign, Mr. Manafort and his Russian associate, Konstantin V. Kilimnik, discussed a plan for peace in Ukraine. Throughout the campaign and the early days of the Trump administration, Russia and its allies were pushing various plans for Ukraine in the hope of gaining relief from American-led sanctions imposed after it annexed Crimea from Ukraine.

Correction: January 9, 2019
A previous version of this article misidentified the people to whom Paul Manafort wanted a Russian associate to send polling data. Mr. Manafort wanted the data sent to two Ukrainian oligarchs, Serhiy Lyovochkin and Rinat Akhmetov, not to Oleg V. Deripaska, a Russian oligarch close to the Kremlin.
Does this mean that it's Poroshenko who got Trump elected, not Putin?

Serhiy Lyovochkin and Rinat Akhmetov are not supporters of Poroshenko whatsoever, but are forces in Ukranian pro-Russian groups... Lyovochkin was chief of staff during the pro-Russian president Yanukovych.

Why Mr. Manafort wanted them to see American polling data is unclear. He might have hoped that any proof that he was managing a winning candidate would help him collect money he claimed to be owed for his work on behalf of the Ukrainian parties.

Once simply democratically elected ...

Ukrainian Prime Minister, once seen as archvillain, reinvents himself | New York Times - Sept. 30, 2007 |

KIEV, Ukraine, Sept. 29 - Once a divisive figure reviled by some here as a shady reactionary and Kremlin pawn, Prime Minister Viktor F. Yanukovich has turned into arguably the nation's most popular politician

[...]

But Mr. Yanukovich has not done it all on his own. From an anonymous office off Kiev's main square, a seasoned American political strategist who was once a senior aide in Senator Bob Dole's Republican presidential campaign has labored for months on a Yanukovich makeover.

Though the strategist, Paul J. Manafort, has sought to remain behind the scenes, his handiwork has been evident in Mr. Yanukovich's tightly organized campaign events, in his pointed speeches and in how he has presented himself to the world.

Mr. Manafort is by no means the only well-known American strategist lured to Kiev by the prospect of sizable fees and the chance to shape the course of a young and tumultuous democracy.

President Yushchenko's party, Our Ukraine, has received advice from the firm run by Bill Clinton's pollster, Stan Greenberg; from Stephen E. Schmidt, campaign manager for Gov. Arnold Schwarzenegger of California; and from Neil Newhouse, a pollster who worked for Mitt Romney, the Republican presidential candidate, when he was Massachusetts governor.

From my diary in February 2017 - Brexit: Putin Did It ...

Will Donald Trump's Data-Analytics Company Allow Russia to Access Research on U.S. Citizens? | The Tablet Magazine |

The Trump campaign has hired Ted Cruz's former data-analysis firm, Cambridge Analytica--and in doing so, it has connected itself with a British property tycoon, Vincent Tchenguiz, and through him with the Ukrainian oligarch Dmitry Firtash, a Bold business associate of Trump's campaign manager, Paul Manafort, who resigned last week. It would be hard to find a better example of why the ownership of the companies that collect data on the American electorate matters.

What Cambridge does is what marketers have done for some time now: segment potential customers (in this case, voters) by their buying habits, lifestyle, and psychology. It most famously worked on the "Leave." campaign during Brexit voting in the United Kingdom..

Key words | Ted Cruz | Paul Singer | Cambridge Analytica | Robert Mercer | Donald Trump | Steve Bannon | Erik Prince |

Thank goodness the Judicial branch of government was wide awake ...

The New York Times report said the FBI investigation was a joint counterintelligence and criminal probe. The counterintelligence part sought to establish whether President Trump was knowingly aiding the Kremlin against America's interests, or "had unwittingly fallen under Moscow's influence".

I'm sure the people of the CIA were willing to execute any orders Deep State would hand down. Kafkaesque - the return of the days of J. Edgar Hoover. The era of the fifties and McCarthy. Nothing new to see here. Congress could help out by establishing a white-wash commission to publish a very lively and BIG report. The American people can always place the memory of a former president by christening a ship, oil tanker or civilian airport in his name.

DR Congo presidential election: Outcry as Tshisekedi named winner - BBC
Opposition candidate Felix Tshisekedi has won DR Congo's presidential election, electoral officials say.

The announcement, made overnight, sparked accusations of an "electoral coup" from runner-up Martin Fayulu.

The Catholic Church said that the result did not match data collected by its election monitors.

The ruling party, whose candidate finished third, has not yet contested the result, prompting allegations of a power-sharing deal with Mr Tshisekedi.

It is an accusation Mr Tshisekedi's team denies.

Catholic bishops casting doubts:

Congo: Felix Tshisekedi 'win' challenged by local Catholic church - DW

Catholic leaders in the Democratic Republic of Congo (DRC) on Thursday said Tshisekedi's surprise win -- declared pre-dawn by the mineral-rich nation's electoral commission -- did not match tallies compiled by 40,000 monitors deployed by the church for the 30 December election.

Diplomatic sources said the tallies pointed to Fayulu as the winner, although the church via its Episcopal Conference of the Democratic Republic of Congo (CENCO) itself did not name a presumed winner.

Also, from former colonial (and neo-colonial) powers:

French Foreign Minister Jean-Yves Le Drian said the surprise result was the "opposite to what we expected," based on field observations of the December 30 vote that was marred by voting machine malfunctions and Ebola virus outbreaks.

Belgian Foreign Minister Didier Reynders said Thursday that Belgium, Congo's former colonial ruler, would use its temporary UN Security Council seat to "find out what's going on."

Last month [DEC 2018] it announced that a baby admitted to an Ebola treatment center just six days after birth had recovered from the virus. The ministry called baby Benedicte, whose mother had Ebola and died in childbirth, the outbreak's youngest survivor.

Experts have reported worryingly high numbers of children with Ebola in this outbreak. Children account for more than one-third of all cases, UNICEF[?!] said last month. One in 10 Ebola cases is in a child under 5 years old, it said, and children who contract the hemorrhagic fever are at greater risk of dying than adults.

India citizenship bill ignites mass protest over migration fears
On Tuesday, India's lower house of parliament apporoved a bill that would grant citizenship rights to foreign Hindus and certain religious minorities, including Christians and Sikhs, who illegally entered India before December 2014 after fleeing Bangladesh, Pakistan and Afghanistan.
[...]
Critics have called the bill an attempt by the ["Modi's"] BJP to boost its Hindu voter base ahead of the upcoming general election due for May. "The BJP are playing politics by creating sentiment among migrants to win political support," former Assam chief minister, Prafulla Kumar Mahanta, told DW, adding that a lot of people from Bangladesh would now come to settle in Assam. Assam shares a long border with Muslim-majority Bangladesh, although the bill does not grant citizenship rights to Muslim immigrants.

History of British India, Lecture 03: "In the hegemonic account of India, for example, certain tropes feature regularly, among them the idea that Indian identity is defined by caste and religion, that India is a land of immense religiosity and that India is unchanging. ... So before Vinay Lal is a UCLA professor or an Indian he is either a Muslim or a Hindu. In the orientalist account. Then if he's a Hindu, then he needs to have a caste."

Researchers Create App to Detect Opioid Overdoses
Through sonar monitoring the app can track those vital signs from a 3-foot distance, sort of like a personal attendant that can call emergency services.
Our proof-of-concept contactless system converts the phone into a short-range active sonar using frequency shifts to identify respiratory depression, apnea, and gross motor movements associated with acute opioid toxicity. We develop algorithms and perform testing in two environments: (i) an approved supervised injection facility (SIF), where people self-inject illicit opioids, and (ii) the operating room (OR)
The team behind the smartphone app say opioid users who inject drugs alone have no way to ask for help if they experience an overdose but the app Second Chance® can monitor breathing and even body movement.

DNA discoverer James Watson loses honors over views on race | The Guardian - 1 hour ago |

The Cold Spring Harbor Laboratory said it was revoking all titles and honors from Watson, 90, who led the lab for many years.

The lab "unequivocally rejects the unsubstantiated and reckless personal opinions Dr James D Watson expressed on the subject of ethnicity and genetics", its president, Bruce Stillman, and chair of the board of trustees Marilyn Simons said in a statement.

"Dr Watson's statements are reprehensible, unsupported by science, and in no way represent the views of CSHL, its trustees, faculty, staff, or students. The laboratory condemns the misuse of science to justify prejudice."

In 2007, the lab removed him as chancellor after he told the Sunday Times  he was "inherently gloomy about the prospect of Africa" because "all our social policies are based on the fact that their intelligence is the same as ours, whereas all the testing says, not really".
