Turkey's election board orders rerun of Istanbul mayoral vote
Turkey's top election board announced on Monday that the vote for the mayor of Istanbul, the country's largest city and economic hub, will be redone.

The new vote will be held on June 23, the board said in a statement, adding the March 31 election was cancelled because of "situations which affected the result and honesty" of the polls.

Some ballot box committees were formed illegally by district election board members who will face criminal complaints, the High Election Board said.

It also voted to cancel the mandate of Istanbul Mayor Ekrem Imamoglu of the main opposition Republican People's Party (CHP).

Imamoglu was declared the mayor of the metropolis on April 17, pending the AK Party's last objection to the close results.

Facebook hit by landmark censorship lawsuit in Poland
SIN claim that articles 23 and 24 of the Polish Civil Code have been breached as a result of the take downs, infringing on the group's rights including freedom of speech as well as damaging its reputation.
[...]
A fair world wide web should be free from censorship not only [BWAH!] by the state, "but also by private companies," it adds.

The case, which is being brought before the Warsaw District Court [!] on Tuesday (7 May), is supported by the Panoptykon Foundation, a Polish NGO whose proclaimed mission "is to protect fundamental rights and freedoms in the context of fast-changing technologies."

How's that PiS high court shuffle working out for y'all?

And, yes, US case law enforcing Titles VII, VIII in the Civil Rights Act of 1964 prohibiting discrimination in public accommodation, housing, and employment by race, sex, religion, age, or country of origin is irrelevant, as a matter of law, to the petition before POLAND judicial courts.

Why the European Parliament's election video is going viral
The "Choose your future" title is a classic one. That is what the European elections are about as Europeans are voting for their MEPs, who will make tomorrow's laws.

However, it is an original take on birth as it is both raw and emotional. The first part shows about fifteen women giving birth to little Europeans, who were born in February and March 2019 in Greece, Czech Republic, Denmark and Hungary. There were shots of quite distressing pain, followed by raw images of giving birth and various reactions.

Inequality tops agenda as Lithuania elects new president
Nine candidates are vying to replace two-term independent incumbent Dalia Grybauskaite, but surveys show that only three stand any real chance of making it to the expected 26 May run-off coinciding with European parliament elections. The story is that two serious candidates defeated populism in the face of the policeman Skvernelis and lesser wannabes.

The Prime Minister Skvernelis is going to keep his vow to resign after this failure, signaling that the common electorate is making a mistake by yielding to high-brow public shaming of his party. Next Parliamentary election is scheduled for October 2020.

Both Nausėda (a mainstream economist) and Šimonytė (a former finance minister) look very similar to the outgoing Grybauskaitė (a former EU finance commissioner), particularly regarding expected EU/NATO/economic/social policies. Nausėda has a better chance, as much of the Soviet generation feels antipathy to the conservatives. On the other hand, Skvernelis called Nausėda a covert conservative this week (and was politely rebuked, of course).

Spanish workers slam Dutch flex work excesses, brief MEPs
Complaints by Spanish workers who are say they are being exploited by Dutch employers have been brought to the attention of the European parliament ahead of this week's debate about a new European Labour Authority which connects national labour inspectorates, the Financieele Dagblad reports.

Complaints from Spanish workers, presented to the European parliament at the invitation of the ruling socialist party PSOE last week, include fewer working hours than initially promised, poor living and working conditions and contracts promising a fixed monthly wage that turn out to be zero hour contracts.

Truck drivers become key EU election issue in Bulgaria
The European Commission wants to put restrictions on cargo transport to ensure adequate rest for truck drivers and limit driving distances. Bulgaria, where the transport sector accounts for 15% of GDP and employs some 200,000 people, fears it will erode its workforce's low-cost advantage. It says it could cost jobs and force Bulgarian truckers to move to Western Europe, worsening a wealth gap within the EU
[...]
The new rules concern truck drivers' postings, driving and rest times, and access to the market. Especially worrying for Bulgarian truckers is the requirement that they spend their rest time in a hotel rather than in bunks in their trucks. The rules would also force drivers to return home every three or four weeks with an empty truck.

[EP candidate Angel] Dzhambazki said that the European proposal, called the Mobility Package, would cause thousands of Bulgarians to emigrate to wealthier European countries to be closer to the markets they work with. He sees the proposal as an effort by countries like France and Germany to protect their own businesses from the competition of lower-wage countries like Bulgaria.
[...]
"Like the Germans or Italians who come to Bulgaria and feel comfortable here, we also need to feel comfortable when we go there because we are a big family," [Eurospeed transport owner, Dimitar Rashkov] says. "That is what the European Union stands for."

Fact-check: Is equal EU minimum wage possible, as Bulgarian socialists claim?
Earlier in May, European Commission First Vice-president and lead candidate of the Party of European Socialists (PES) for the new Commission president, Frans Timmermans, called on the EU countries to introduce a European minimum wage standard.
[...]
The European debate is about introducing a common standard for the minimum wage, which is 60% of the average wage in the country. ... Timmermans is, in fact, putting pressure on the six EU members without an official minimum, namely Austria, Cyprus, Denmark, Finland, Italy and Sweden. Opponents of the minimum wage see the policy as dragging down competitiveness and sovereignty [!], as well as levelling down salaries [!] - some sort of a race to the bottom.
[...]
Predictably, the highest minimum wages are in Luxembourg - just over €2,000. In the richest EU countries, the minimum wage varies from €1,100 to €1,680. Citizens of these countries would not support the introduction of an equal minimum wage standard[?], if such an idea was ever to be discussed at EU level. That would bring them closer [?] to the poorer countries, where the normal salary is two times lower than their minimum wage.

It appears that Bulgaria is called Angel Dzhambazki. His political party is not specified in the article. The Bulgarian National Movement, as its name indicates, is a right wing party. One suspects that Angel's worry is more for the Bulgarian trucking companies than the drivers (his claim that the drivers would move to western Europe is interesting, because they would earn much higher wages there...)

EU Employers Must Track Hours, Not Just Overtime, [ECJ] Rules

Backing a union[s'] suit[s] against Deutsche Bank, the European Court of Justice ruled Tuesday that all employers must be required to have a system for tracking the working hours of staff.

When the Spanish trade union CCOO, short for Federación de Servicios de Comisiones Obreras, initiated the dispute, Deutsche Bank shot back that its obligations under Spanish law include merely keeping a record of overtime and communicating those figures each month to the staff and their representatives.

(Reference for a preliminary ruling -- Social policy -- Protection of the safety and health of workers --Organisation of working time -- Article 31(2) of the Charter of Fundamental Rights of the EuropeanUnion -- Directive 2003/88/EC -- Articles 3 and 5 -- Daily and weekly rest -- Article 6 -- Maximum weekly working time -- Directive 89/391/EEC -- Safety and health of workers at work -- Requirement to set up a system enabling the duration of time worked each day by each worker to be measured)

Israel slams Putin adviser for claim Ukraine to move Jews into `cleansed' area- Times of Israel
Israel on Tuesday criticized an article authored by a close adviser to Russian President Vladimir Putin, which claimed that Ukraine's president may want to move Israeli Jews into parts of his country, as "conspiratorial and anti-Semitic."

Jerusalem was "puzzled" by Sergey Glazyev's article, Foreign Ministry spokesperson Emmanuel Nahshon told The Times of Israel.

"The conspiratorial and anti-Semitic style of his words is inappropriate and does not reflect the positive nature of Russia's relations with Israel," Nahshon added.

From the blog post in question (Google translate):

Perhaps the stake on Zelensky, made long before these elections, is connected with the general list of the Trump administration towards the far-right forces in Israel. Probably, they will set new tasks for the updated Kiev regime. I do not exclude, for example, the possibility of a massive move to the "cleared out" of the Russian population of the land of the South-East of Ukraine by the inhabitants of the Promised Land tired of the permanent war in the Middle East - just like the Christians fleeing from Islamizing Europe.

Sardinia's Happy Village for seniors with suitcases
Mayor Corrias was inspired by the albergo diffuso concept, translated in English as diffused, virtual or scattered hotel. Alberghi diffusi offer hotel services in a number of houses scattered around a small town or village. In Happy Village, residents will pay a monthly fee for a package that includes accomodation, health professionals on call round the clock, a restaurant, a sports centre, transport and cleaning.

According to INPS, the Italian pension authority, around 400,000 Italian retirees are spending their pension abroad. The pensionati con la valigia (seniors with suitcases) are lured by tax breaks in Portugal, the low cost of living in Tunisia or cheap property in Bulgaria. Sardinia cannot offer tax breaks yet, but an economic advisor to Interior Minister Salvini has suggested that Italy follow the Portuguese model in order to repopulate Sardinia, Calabria and Sicily.

However the rape accusation in Sweden had a political motive as the charges on appeal were brought forward by a new prosecutor in Göteborg, Marianne Ny.

I could refer you to my posts of ten years ago concerning rape in the context of cultural relativism, i.e. Swedish law vs Australian practice.
But probably only another New Zealander would find it funny (we have been telling jokes about Australian sexual unsophistication since probably the 19th century)

They knew he was an Australian (what did they expect, roses?)
But he knew he was in Sweden. So fk him.

However I consider he has already served ten years prison for that (alleged) offense, so if it turns out that the UK extradites him to Sweden, then they drop the rape charges, and decline to extradite him to the US, that would be an ironic and fitting end to the story.

Assange Faces 17 New Charges Over Leak of Classified Info
The superseding indictment filed in the Eastern District of Virginia brings the total number of U.S. charges against Assange to 18.

Assange, 47, was indicted in Marchon one count of conspiracy to commit computer intrusion for allegedly helping Manning crack a password to a classified military database, which allowed her to gain access to hundreds of thousands of secret military documents about the wars in Iraq and Afghanistan as well as information about detainees held at Guantanamo Bay.
[...]
Terwilliger said the charges also do not involve all of the documents WikiLeaks released, but just a specific subset that revealed particularly sensitive information that endangered the lives of people who provided information to the United States.

Demers also distanced Assange from journalists by saying no journalist would publish information identifying intelligence sources operating in dangerous conditions.

"Julian Assange is no journalist," Demers told reporters.

Because east-west has decreased pretty steadily since 2001 (why it increased from 1997 to 2001 is a good question), and west-east is fairly stable, and eventually the two lines crossed. I wonder how much of the west-east that is movement to former East Berlin?

Austria: Secret video ensnares far-right leader

'Whores'

In the video, the woman can be heard telling Strache that she is very wealthy and wants to buy a large block of shares at Austria's largest newspaper, the Kronen Zeitung. She reportedly claims to be interested in the paper so that she can provide favorable pre-election coverage of the FPÖ. In return, she demands political favors.

German parliament condemns 'anti-Semitic' BDS movement
Parliamentarians said some BDS slogans recalled Nazi propaganda.
[...]
The resolution was brought by all the centrist parties in the German Bundestag, including Angela Merkel's Christian Democratic Union (CDU) and its Bavarian sister party the Christian Social Union, the Social Democrats (SPD), the Free Democratic Party (FDP) and the Greens.

The far-right Alternative for Germany (AfD) brought its own alternative resolution, calling for an outright ban on BDS. The socialist Left party brought a milder resolution, calling for the condemnation of any anti-Semitic BDS statements.

Speaking in Friday's debate on the issue, CDU Bundestag member Axel Müller reminded the chamber that upholding Israel's right to exist remained a basic principle of the German state. He also claimed that the BDS campaign's social media accounts [!] showed that it was occasionally influenced [!] by the "propaganda of the [Nazi] dictatorship."

And Strache has resigned. Norbert Hofer takes over. If this is all then not a particularly great outcome, Hofer was always the smarter one. We'll see what the chancellor will say. Continuing the coalition opens up a lot of loot. Conversely you could save the Republic™ and then get more of the loot if the elections work out.

Austria chancellor calls for snap election after corruption scandal - BBC
Austrian Chancellor Sebastian Kurz has asked for a snap election after his Vice-Chancellor, Heinz-Christian Strache, resigned over a corruption scandal.

Mr Kurz's centre-right People's Party is in government with Mr Strache's far-right Freedom Party.

The Freedom Party leader stepped down after secret video footage emerged.

The video appears to show him discussing government contracts with an alleged Russian investor.

Mr Strache blamed his actions on alcohol and acting like a "teenager", saying his behaviour had been "stupid" and "irresponsible", and that he was leaving to avoid further damage to the government.

"I have suggested to the president of the republic that new elections be carried out, at the earliest possible date," Mr Kurz said.

"After yesterday's video, I must say quite honestly: Enough is enough," he said.

Until this episode, the conventional wisdom (well, Politico.eu) was presenting Kurz as the Wunderkind of European "center-right" politics, the epitome of "generational change" (Kurz is 31).

And many EPP parties across Europe have been looking at his coalition with the extreme right, a move that may become inevitable, despite all claims to the contrary: between loosing power and allying with fascists, they are not going to drop power.

Kurz is was 31 when he formed the coalition. It's pretty funny, really. All the paid opinion havers on the TV tell me he has a great political talent and great message discipline. But in practice that just means he sticks to his prepared talking points and doesn't engage with questions, similar to Maybot3000. That's also the most likely reason that he hid out for close to two days. Had to practice the speach. Although rumor(from FPÖ sources) has it that he initially wanted to grab the interior ministry and keep going.

In his speech he plainly states that there is no political convergence with the SocDems, he was a victim of (former SPÖ campaign manager) Siberstein like campaigning and he had been very happy with the coalition. Apparently he just didn't notice that they were working at the Orbanisation of the Austrian media landscape? Yet it seems the state broadcaster did notice, they were incredibly careful in not putting any blame at the Kurz's doorstep. There was one truly bizarre episode when their domestic policy chief wanted to detect increasing anger and aggression in the crowd that reminded him of the time the first far-right government had to sneak into the Hofburg through a tunnel. His younger colleague only found a "party mood", the police guy had "no incidence" and all the while he was talking you could see a little kid sitting on someone's shoulders right behind him in the crowd, but what do they know.
True to form in Russian election interference scandals we are again mainly looking at some idiots getting scammed by fake oligarchs.
And talking about election interference: In a curious coincidence, their "very good Israeli friends" arrested Silberstein right in the hot phase of the last election.

A few additional things I, or possible a random Twitter user, picked up:
They were handing out infrastructure projects well in advance to formal coalition talks. Just like they knew they'd get the ministry after the election.
Austria's oligarchy can't be happy of getting named in connection with illegal party financing.
The Kronenzeitung will probably stop pushing the FPÖ for a bit, but I think they have been on the Kurz train for  a while anyway.
This will probably turn out pretty expensive for the republic, also very on brand for the far-right. Haselsteiner, the oligarch behind the NEOS party and the one Strache wanted to explicitly cut out of infrastructure contracts will have an easy case.
The SPÖ still seems very unprepared for elections.

I didn't find a good source, but the number for government inserts seems to total around 24 million a year. The legal limit that a party can spend on an election is 7 million. ECJ Rebukes Hungary for 2014 Land-Use Cancellations
Hungary adopted the scheme back in 2013, saying that only people with a close family tie to agricultural land in the nation were entitled to property-use rights, which are otherwise known as usufruct. In October 2014, about five months after Hungary had canceled the land-use rights of nationals of outside member states, the European Commission warned the government that it was infringing the Treaty on the Functioning of the European Union.
[...]
Insisting that the commission could not show discrimination, Hungary pointed out that only 5,058 of the more than 100,000 people affected by the scheme were nationals of other countries including third states.
[...]
"That exception takes into account the fact that parents frequently buy property for their children over which they create a right of usufruct for themselves and the fact that a surviving spouse often inherits such a right," Hungary argued, as summarized in the ruling Tuesday.

Rejecting the country's submissions, however, the Grand Chamber of the European Court of Justice ruled Tuesday that "the restrictions on the free movement of capital thus arising from the deprivation of property acquired using capital protected by Article 63 TFEU cannot be justified."

Many commentators in the U.K take it as read that Britain will lose global influence as a result of Brexit. But there is absolutely no reason why this should be the case. Britain's international standing has never depended on our membership of the European Union. It is rather a factor of our economic weight, history, culture, democratic values, the excellence of our institutions, such as the universities and armed forces, the royal family and all the other trappings of our soft power.
The soft power just got softer.

"Apple's line-drawing does not make a lot of sense, other than as a way to gerrymander Apple out of this and similar lawsuits," Kavanaugh wrote. Supreme Court says secret UK spy court's judgments can be overruled after all
Britain's Supreme Court said today that rulings from a secretive UK spy tribunal can now be appealed against after a legal challenge from pressure group Privacy International.
1. The Investigatory Powers Tribunal ("IPT") is a special tribunal established under the Regulation of Investigatory Powers Act 2000 ("RIPA") with jurisdiction to examine, among other things, the conduct of the Security Service, the Secret Intelligence Service and the Government Communications Headquarters ("the intelligence services").
[...]
3. Reduced to its core the central issue in the present case is: what if any material difference to the court's approach is made by any differences in context or wording, and more particularly the inclusion, in the parenthesis to section 67(8), of a specific reference to decisions relating to "jurisdiction"?
The statutory provisions
4. The legislative scheme established by RIPA replaced three earlier statutes dealing with the oversight of the security services. Its enactment was closely linked to that of the Human Rights Act 1998 ("HRA"), which was brought into force at the same time.
[...]
The European Court of Human Rights [ECHR] has held that the Act and the rules provide an effective and compliant remedy for complaints in respect of interception with communications, for the purposes of article 13 of the Convention (Kennedy v United Kingdom (2011) 52 EHRR 4).
The judge also commented in an aside in the 113-page judgment that MPs cannot make laws that stop the High Court from enforcing the law: "Parliament cannot entrust a statutory decision-making process to a particular body, but then leave it free to disregard the essential requirements laid down by the rule of law for such a process to be effective."

inre: "legislative purpose"
Watkins v. United States, 354 U.S. 178 (1957), The apple does not fall far from the tree.
The rudiments of the power to punish for "contempt of Congress" come to us from the pages of English history. The origin of privileges and contempts extends back into the period of the emergence of Parliament. The establishment of a legislative body which could challenge the absolute power of the monarch is a long and bitter story. In that struggle, Parliament made broad and varied use of the contempt power. Almost from the beginning, both the House of Commons and the House of Lords claimed absolute and plenary authority over their privileges. This was an independent body of law, described by Coke as lex parliamenti. [Footnote 9] Only Parliament could declare what those privileges were or what new privileges were occasioned, and only Parliament could judge what conduct constituted a breach of privilege.

In particular, this exclusion of lex parliamenti from the lex terrae, or law of the land, precluded judicial review of the exercise of the contempt power or the assertion of privilege. Parliament declared that no court had jurisdiction to consider such questions. In the latter part of the seventeenth century, an action for false imprisonment was brought by one Jay, who had been held in contempt. The defendant, the Serjeant-at-Arms of the House of Commons, demurred that he had taken the plaintiff into custody for breach of privilege. The Chief Justice, Pemberton, overruled the demurrer. Summoned to the bar of the House, the Chief Justice explained that he believed that the assertion of privilege went to the merits of the action, and did not preclude jurisdiction. For his audacity, the Chief Justice was dispatched to Newgate Prison. [Footnote 10]

It seems inevitable that the power claimed by Parliament would have been abused. Unquestionably it was. A few examples illustrate the way in which individual rights were infringed. During the seventeenth century, there was a violent upheaval, both religious and political. This was the time of the Reformation and the establishment of the Church of England. It was also the period when the Stuarts proclaimed that the royal prerogative was absolute. Ultimately there were two revolutions, one protracted and bloody, the second without bloodshed. Critical commentary of all kinds was treated as contempt of Parliament in these troubled days.
[...]
The history of contempt of the legislature in this country is notably different from that of England. In the early days of the United States, there lingered the direct knowledge of the evil effects of absolute power. Most of the instances of use of compulsory process by the first Congresses concerned matters affecting the qualification or integrity of their members or came about in inquiries dealing with suspected corruption or mismanagement of government officials. [Footnote 19] Unlike the English practice, from the very outset, the use of contempt power by the legislature was deemed subject to judicial review. [Footnote 20] ...

Frankly, since I checked up on house.gov, I'm more alarmed by other items on the committees' agenda. It appears, too, that suspending floor rules on roll call has eased a number of bills' passage without press over the past couple of weeks ...

Self-impeach? Talk shifts toward Trump defiance of Congress
"The president is self-impeaching," [Pelosi] told her colleagues last week during a private caucus meeting, echoing comments she also aired in public. "He's putting out the case against himself. Obstruction, obstruction, obstruction. Ignoring subpoenas and the rest." She added, "He's doing our work for us, in a certain respect."

Got that? Current (116th) Oversight Committee (D) inherited 112th-113th session Oversight Committee (R) subpoena denied by AG Eric "Fast & Furious" HOLDER, found in contempt (2012), and sued. 44th president asserts executive privilege to um obstruct production of FBI "evidence", LYNCH succeeds HOLDER (114th); SESSIONS succeeds LYNCH (115th); acting ROSENSTEIN succeeds SESSIONS (116th); BARR succeeds acting ROSENSTEIN. 116th Oversight Committee (D) files motion to dismiss 112th Oversight Committee(R) appeal of court decision affirming executive privilege. Current AG agrees.

116th  Oversight Committee (D) serves current AG subpoena for "evidence", AG denies subpoena, 116th finds contempt, 45th president asserts executive privilege ...

tbh we always knew he was agonna be a dictator. He was telling us that in the run-up to the election.

Medium - Sarah Benincasa - Welcome to the Dictator Playbook

When they tell you to rally behind President Trump because we've been hit by evil, remember how gleefully he painted the target.

If you are too young to remember how Bush and Cheney used an act of terror by Saudis and others to create a lie about Iraq, read about it. Trump didn't ban Saudis from coming here. There's a reason for that, and it's not because they didn't constitute the majority of 9/11 hijackers (spoiler: they did).

Friday's actions do not represent a sensible method to buy time to evaluate already-stringent visa procedures. They are grooming you the way a molester grooms a child. The molester tests boundaries first.

This is a test of your boundaries, my fellow American. How far can he push you before you speak up? Will you speak up? Will you fight back? You're not a child. You have some power. Band together with others and you have more.

Trump and Pence are following a well-worn playbook. What does it say?

Blame the immigrants; label dissenters and witnesses as threats; divide.

(And conquer. That's the best part, for guys like this.)

2017: It's clear to me that this writer's contempt for 45 was passionate and shrouded in fable. I wonder if she's satisfied today "now that the Democrats are in control of the House". I'm thinking of Gabor Mate and also Sema Hernandez, progressive ingenue, recently show-cased by Jimmy Dore. I'm thinking of the sophist Jeff Toobin Esq.
So, after nearly two and a half centuries, Trump will create a new [?] constitutional norm--in which the executive can defy the legislature without consequence. The only likely remedy, therefore, will lie with the voters, next year.
As I read, there are far too many people rehearsing elevator pitches and waving permission slips at their "media" reflections.

US government and its rude, faux frontier nobility have from time to time embraced "dictators" since the inception of their republic. I wonder idly, what children learn in elementary school. Have teachers left off the cherry tree and graceful retirement of His Excellency Geo. Washington from the catechism of model American democracy? I would guess so, considering that "constitutional crisis" case load per term has increased from 1,195 in 1950 to 7,000-8,000 in the 21st century, yet this year, this president, this congress is supposedly different.

Rly?

I count three. John Adams, FDR, GWB. I wouldn't count Trump and his asinine humor, because I pretty certain  Trump has not ushered any legal, or "legitimate," authority into the office that has not already been delegated to his predecessors by the US Congress. But I might be persuade by the four "red scares" that I've counted. Two coincide with "dictator" administrations --his and FDR's. To the administrations of Adams, FDR, and GWH we must admit, however, the most alarming marriage of ideal "national security" privileges and whichever, spectacularly undesirable "aliens" available to each. Sadly, jewish refugees were far down christ Roosevelt's list of "collateral damage", Ms Benincasa.

Again, authority was delegated to the office and endorsed by the US Congress. That's the group of people who cannot be shifted either to review, repeal, or replace their "institutional knowledge," much less overide a presidential veto. That is the group of "representatives," for whom voters take no responsibility. For that would surely, poorly reflect the values of the nation whose civic duty, "turn out," is reduced to one ballot every four years.

"He's doing our work for us, in a certain respect," said the speaker of the House.

The Coming War on China, (2016) running time 01:49:49

ERIC X. LI: I make the joke how in America you can change political parties, but you can't change the policies. In China you cannot change the party, but you can change policies. So in sixty-five or sixty-six years China's been run by one single party, yet the political changes that have taken place in China these past sixty-six years have been wider and broader and greater than probably any major country in modern memory. China is a market economy, and it's a vibrant market economy, but it is not a capitalist country. Here's why. There's no way a group of billionaires can control the politburo as it does American policy-making. So in China you have a vibrant market, but capital does not rise above political authority. Capital does not have enshrined rights. In America capital, the interest of capital and capital itself, has risen above the American nation. The political authority cannot check the power of capital. And that's why America is a capitalist country, but China is not.

`Shocking': Ohio State doc abused 177, officials were aware
The findings put Strauss in a league with gymnastics doctor Larry Nassar of Michigan State University, who was accused of molesting at least 250 women and girls and is serving what amounts to a life sentence. Michigan State ultimately settled with his victims for $500 million.

Similarly, the Jerry Sandusky child sexual-abuse scandal that brought down legendary Penn State football coach Joe Paterno in 2011 has cost the university more than a quarter-billion dollars in settlements, fines, legal costs and other expenses.

Many of Strauss' accusers who have spoken publicly said they were masturbated or otherwise touched inappropriately during physical exams or leered at in the locker rooms. Many told investigators that they thought his behavior was an "open secret" and that they believed their coaches, trainers and other team doctors knew was going on.

The students described the examinations as being "hazed" or going through a "rite of passage." Athletes joked about Strauss' behavior, referring to him with nicknames like "Dr. Jelly Paws."

$44 million settlement reportedly close in Weinstein sexual misconduct harassment and assault lawsuits
"We now have an economic agreement in principal that is supported by the plaintiffs, the AG's office, the defendants and all of the insurers that, if approved, would provide significant compensation to victims, creditors and the estate, and allow the parties to avoid years of costly, time consuming and uncertain litigation on all sides," Adam Harris, a lawyer for studio co-founder Bob Weinstein, told a bankruptcy court judge in Wilmington, Delaware, on Thursday.
[...]
More than 15 lawsuits have been filed accusing Harvey Weinstein or the company of misconduct raketeering. The settlement would cover many of them, including a class action [!] by alleged victims and a suit by the New York attorney general.

The class-action [!] complaint accuses the company of operating like an organized crime group to conceal widespread sexual harassment and assaults.

  1. Last Slave Ship From Africa Found off Alabama Coast. "wreck of the last ship known to bring enslaved people from Africa to the United States": 1860 at Mobile, ALABAMA, absolutely, positively plausibly the ONLY ONE since 1808. Because criminals always telegraph the bailiff a manifest and itinerary before landing. srsly.
  2. Africatown: "110 African men, women, and children between the ages of 5 and 23" ["a group"] establishes "the settlement of African Town as the first [!] town [?!] founded [1868, by "survivors" aged 13-31?!] and continuously occupied and controlled by blacks [!] in the United States" --excluding, for instance, the Gullah Geechee Corridor, the  gulag archipelago running the coast of South Carolina, North Carolina, Georgia, and Florida.
  3. The Gullah: Rice, Slavery, and the Sierra Leone-American [!] Connection --"The plantation owners were willing to pay higher prices for slaves from this area, and Africans from the Rice Coast were almost certainly the largest group [!] of slaves imported into South Carolina and Georgia during the 18th century." [Saving Cokie Roberts', Founding Mothers, the dubious fucking honor of corroborating their entrepreneurial genius and fluency in English, French, and Portuguese, because victims of the patriarchy] See last "group" of descendants of slaves 'lose' homesteads
  4. 1926 Slave Revolt in Sierra Leone
Slavery is an important part of the history of the Sierra Leone Colony and Protectorate.  In those years prior to the abolition of the Atlantic slave trade in 1807 [1792-1807 "settlement"], these settlers from Great Britain, Nova Scotia, and Jamaica struggled to survive. They were resented by the adjacent African and European slave traders. Some of these returned African freed slaves became slave traders themselves in order to survive.1 [...] When slavery was abolished in the British Empire in 1833, slavery was also abolished in Sierra Leone. However, slavery outside the borders of the Crown Colony was not affected. Even when the Protectorate was established in 1896, slavery was still legal in the Protectorate until 1928. Beginning in 1833, slaves of the tribes near the Crown Colony would enter the Crown Colony to become free. In 1841, the British established a legal principle that they would not return a fugitive slave who had escaped to Freetown.5 This legal principle continued until the abolition of slavery in the Sierra Leone Protectorate in 1928.6

Trump says 'very dangerous' Huawei could be part of U.S.-China trade deal

Huawei and its 68 subsidiaries were put on a U.S. trade blacklist last week, prompting the likes of Google to cut ties with the brand. The lack of an Android license combined with ARM's withdrawal means Huawei's ability to make a phone is nonexistent, and it looks like there won't be a quick resolution.

In a meeting at the White House on Thursday, US president Donald Trump called Huawei "very dangerous":

Huawei is something that is very dangerous. You look at what they've done from a security standpoint, from a military standpoint, it's very dangerous.

But Trump also said that it is "possible" Huawei could be a part of a larger trade agreement between the U.S. and China:

If we made a deal, I could imagine Huawei being possibly included in some form or some part of it.

Damn ... is that guy stupid! Who are the morons who voted him into office? Brainwashed or Soviet era mind games ...

The headlines today are psychotic, because Trump has authorized Barr & DNI discretion to declassify docs embargoed by Mueller's investigation. This unexpected business traverses criminal facts and intelligence "assessments". DLC had argued during the investigation against public disclosures, while also rejecting intelligence briefings, 2017-2018. Constitutional dispute over executive "non-compliance" should be moot, but the fourth estate will stutter until Granny Nancy waves her hand. Fin.

"Trump extends his corruption into the intelligence agencies," writes Washington Post.

"Trump orders intelligence community to cooperate with review on Russia probe origins, Reuters confides.

"Trump orders 'immediate' declassification of FISA documents, DOJ-FBI texts," RT declares.

By releasing a Wikileaks-like dump from US "spy" masters, ironically, DLC's prime suspect has wrested control of "the narrative" of his conspiracy and "obstruction" from them. More significant, declassification obviates officious subpoena service, impeachment preparation, and floor proceedings by majority "leaders". Will they suddenly demand a right to refuse declassification? Or schedule NEW! hearings from witnesses previously deposed in closed sessions?

Do you doubt that bureaucrats tied either to executive or legislative agencies would promote heads of state employed in the fabrication of fed gov political intrigues into www headlines? I do. "Text" that instantiate notable US persons of interest--summarily exonerated by Mueller--must satiate public curiosity. To wit:

pages 10-12 and 17-34 of the June 2017 application to the FISA court, used to justify surveillance of Carter Page, as well as "all FBI reports of interviews prepared in connection with all Carter Page FISA applications." ... "all FBI reports of interviews with Bruce G. Ohr prepared in connection with the Russia investigation" and "all text messages relating to the Russia investigation, without redaction, of James Comey, Andrew McCabe, Peter Strzok, Lisa Page, and Bruce Ohr."
A short list of supporting actors omitted in Mueller's report, waiting top up. The duplicity of the GOP's opposition party has been as astounding and crude as inept.

Critics worry AG will reveal Russia probe info to help Trump an hour ago
Traditionally, when Congress, for instance, asks for material to be declassified, the request is forwarded to the intelligence agencies where the information originated or resides. Those agencies recommend what part, if any, can be declassified without jeopardizing intelligence sources or spy craft. Then, the Office of the Director of National Intelligence coordinates the feedback from all the agencies and makes a decision.

[DNI] Dan Coats said in a statement Friday that 17 intelligence agencies he represents will provide the Justice Department all appropriate information needed for its review of intelligence activities related to Russian interference in the 2016 presidential election.

Coats also said he's confident Drug Czar Barrwill work in accordance with "long-established standards  to protect highly-sensitive classified information that, if publicly released, would put our national security at risk."

But while Trump's memorandum instructs Barr to consult with appropriate intelligence agencies "to the extent he deems it practicable" before he releases anything, it doesn't require him to do so. This has alarmed ["intelligence experts"], who have served in high-level U.S. intelligence posts

wait for it.
California Rep. Adam Schiff, chairman of the House intelligence committee, vowed to conduct oversight of any effort to selectively reveal and distort classified information or manipulate the declassification system.

"The clear intent of this abuse of power is to override longstanding rules governing classified information to serve the president's political interests, advance his 'deep state' narrative, and target his political rivals," Schiff said.

There's this thing about liars ...

In other words, he  accidentally told the truth again.
According to an early donor list mistakenly attached to a invitation to Biden's first fundraiser in Philadelphia on April 25, the event raised tens of thousands of dollars from employees and family members of attorneys at the law firm Cozen O'Connor. The firm specializes in labor disputes, including helping employers "prepare for and respond to picket lines, strikes, lockouts, and other economic campaigns," as well as to "avoid unionization through positive employee relations." Cozen O'Connor's website notes that the firm's attorneys "manage labor relations with a clear eye toward the bottom line."

Of the $70,150 that had been pledged to Biden's campaign at the time the list was released, $46,850 came from checks signed by Cozen O'Connor employees and their family members.

Hong Kong legislators brawl over contentious extradition law

The former British colony is trying to enact rules that would allow people accused of a crime, including foreigners, to be extradited from the city to countries without formal extradition agreements, including mainland China.

Modi surges to victory in India on Hindu-first platform
With most of the votes counted, Modi's stunning re-election mirrored a global trend of right-wing populists sweeping to victory, from the United States to Brazil to Italy, often on a platform promoting a tough stand on national security, protectionist trade policies and putting up barriers to immigration.
[...]
Election Commission data showed Modi's Bharatia Janata winning 158 seats and in the lead for 145 more, which would catapult the party well beyond the simple majority in the 545-member lower house of Parliament required to govern. The results spelled another nail in the coffin of the main opposition Indian National Congress party, which picked up 31 seats and was leading in 21 other contests.
[...]
An estimated 600 million voters cast ballots in India's six-week polls, a testimony to the vibrancy of the world's largest democracy just 72 years since India won independence from British colonial rule.

Voters expressed confidence that Modi could jumpstart India's stalling economy, despite his poor first-term record and failure to deliver on his pledge to create jobs.

The BJP harnessed social media, including Twitter, where Modi has 47.4 million followers, and WhatsApp to reach out to millions of supporters.

Mohit Sharma, a 29-year-old who runs a bathroom fittings business, said India had never had a prime minister like Modi. "In the past, when leaders after they won elections, they sat in air-conditioned rooms and they never reached out to people, but Modi was never like that. He was always connected to the people through social media," Sharma said.

Facebook: Fake account removal doubles in 6 months to 3B
Of the 3.4 billion accounts removed in the six-month period, 1.2 billion came during the fourth quarter of 2018 and 2.2 billion during the first quarter of this year. More than 99 percent of these were disabled before someone reported them to the company. In the April-September period last year, Facebook blocked 1.5 billion accounts.

Facebook attributed the spike in the removed accounts to "automated attacks by bad actors who attempt to create large volumes of accounts at one time." The company declined to say where these attacks originated, only that they were from different parts of the world.

Bloomberg
With Uber Technologies Inc.'s shares plunging nearly 20% below its IPO price on Monday, the stock might be fast approaching a "white knuckle" territory, according to one Wall Street analyst.

After closing down 7.6% on Friday in its trading debut, Uber's stock dropped as much as 13% on Monday in New York, before closing down 11% at $37.10. The initial public offering was priced at $45.

"From a stock perspective, if Uber breaks $35, that is where it starts to get even more white knuckles," Wedbush analyst Daniel Ives said in a phone interview. "Right now the bears are winning, and there is nothing to stop these stocks from moving down, especially in a risk-off environment," the analyst added, noting the weakness in ride-sharing peer Lyft Inc., which is also down as much as 7.3%.

Congressional leaders get classified briefing on Iran
House Speaker Nancy Pelosi, a member of the Gang of Eight, said briefings are necessary because informing leaders "is no substitute for the full membership of the Congress." She said a failure to inform Congress is "part of a pattern" for the Trump administration "that is not right" because the power to declare war resides with the Congress.

"So I hope that the president's advisers recognize that they have no authorization to go forward in any way" against Iran, Pelosi said.

UN declares ["]war["] on ocean plastic
"UN Environment launched today an unprecedented global campaign to eliminate major sources of marine litter: microplastics in cosmetics and the excessive, wasteful usage of single-use plastic by the year 2022."
BREAKING: UN Decides to Control Global Plastic Waste Dumping
187 countries took a major step forward in curbing the plastic waste crisis by adding plastic to the Basel Convention, a treaty that controls the movement of hazardous waste from one country to another. The amendments require exporters to obtain the consent of receiving countries before shipping most contaminated, mixed, or unrecyclable plastic waste, providing an important tool for countries in the Global South to stop the dumping of unwanted plastic waste into their country.
[...]
The decision reflects a growing recognition around the world of the toxic impacts of plastic and the plastic waste trade. The majority of countries expressed their support for the proposal and over one million people globally signed two public petitions from Avaaz and SumOfUs. Yet even amidst this overwhelming support, there were a few vocal outliers who opposed listing plastic under Annex II of the Basel Convention. These included the United States, the largest exporter of plastic waste in the world; the American Chemistry Council, a prominent petrochemical industry lobbying group; and the Institute of Scrap Recycling Industries, a business association largely comprised of waste brokers. As the United States is not a party to the Basel Convention, it will be banned from trading plastic waste with developing countries that are Basel Parties but not part of the Organization for Economic Cooperation and Development.

Elmed interconnector aims to bring solar power from the Sahara to Europe

On April 30, the governments of Italy and Tunisia signed a deal to lay an underwater power cable between Partanna, Sicily and El Haouaria, Tunisia, aiming to integrate the EU's electricity grid with that of North Africa. A long time in the works, Italian transmission company Terna and Tunisian gas and electricity group STEG have been developing the so-called Elmed Mediterranean power interconnector since 2003.
Speaking of Desertec and such, how fares solar thermal in Spain
[...]
Elmed is currently on the third list of EU Projects of Common Interest (PCI), which includes key infrastructure projects that can benefit from accelerated planning and permit granting...."The EIB is in continuous contact with most project promoters of large scale renewable energy projects and would consider possible financing as the two schemes develop," an EIB source told DW, referring to the Elmed as much as to the TuNur project -- a solar power project presented in 2017, which aims at exporting 4.5 gigawatts (GW) of renewable energy through undersea cables to Malta, Italy and France.
[...]
Elmed would not only diversify supply sources and routes for Europeans, but also increase Tunisia's energy security, the [World] bank said. That is because the project, which was originally conceived in 2003 to export solar power generated in the Sahara to Italy, is now designed to be bidirectional.
[...]
A second reason for support for Elmed is that it fits into the European Union's strategy for Africa. Apart from already established ties with Morocco, such as electricity interconnections between Spain and Morocco, European institutions are now focusing on the Sahel area and Tunisia.
EU-ACP Cotonou successor faces one year delay
The ACP does not include North African countries, and Morocco, Egypt and Tunisia, all of whom have been in talks with Brussels about `cash for migrants' arrangements, modelled on the EU's accord with Turkey, do not want to be part of it.

Treaty of Fort Laramie (1868)

From the 1860s through the 1870s the American frontier was filled with Indian wars and skirmishes. In 1865 a congressional committee began a study of the Indian uprisings and wars in the West, resulting in a "Report on the Condition of the Indian Tribes," which was released in 1867. This study and report by the congressional committee led to an act to establish an Indian Peace Commission to end the wars and prevent future Indian conflicts. The U.S. Government set out to establish a series of Indian treaties that would force the Indians to give up their lands and move further west onto reservations. In the spring of 1868 a conference was held at Fort Laramie, in present day Wyoming, which resulted in a treaty with the Sioux. This treaty was to bring peace between the whites and the Sioux who agreed to settle within the Black Hills reservation in the Dakota Territory.

The Black Hills of Dakota are sacred to the Sioux Indians. In the 1868 treaty, signed at Fort Laramie and other military posts in Sioux country, the United States recognized the Black Hills as part of the Great Sioux Reservation, set aside for exclusive use by the Sioux people. In 1874, however, Gen. George A. Custer led an expedition into the Black Hills accompanied by miners who were seeking gold. Once gold was found in the Black Hills, miners were soon moving into the Sioux hunting grounds and demanding protection from the U.S. Army.
