US seeks to seize Grace 1 as Gibraltar moves to release | The Gibraltar Chronicle - Aug. 15, 2019 |

The US Department of Justice has applied to seize the Iranian supertanker Grace 1 in Gibraltar, just hours before the Gibraltar Government was poised to release it.

Gibraltar had been due to lift the detention on the ship this morning but the move by the US means the decision has now been adjourned until 4pm today.

The developments were revealed by Joseph Triay, the lawyer for Attorney General Michael Llamas QC, during a short hearing in the Supreme Court of Gibraltar.

Mr Triay said: "This application was to have taken a very different turn. It was to have been an application for no further order of detention."

The grounds for the US application are not clear at this stage but the court was told it was a request from the Department of Justice for mutual legal assistance.

Gibraltar has decided to free the Iranian oil supertanker Grace 1, detained off the British overseas territory six weeks ago by Royal Marines, despite a last-minute attempt by the United States to seize the vessel.

The Grace 1 was detained on suspicion it was smuggling oil to Syria in breach of European Union sanctions.

Gibraltar Chief Minister Fabian Picardo on August 15 lifted the detention order after formal written assurances from Tehran that the ship will not discharge its more than 2 million barrels of oil in Syria, but added that the ship had not yet been released. The detention order on the Grace 1 was set to expire on the evening of August 17.

"In light of the assurances we have received, there are no longer any reasonable grounds for the continued legal detention of the Grace 1 in order to ensure compliance with the EU Sanctions Regulation," Picardo said.

The decision to release the tanker came despite a last-minute attempt by Washington to seize the tanker.

US Secretary of State Mike Pompeo warned Tuesday that anyone who "touches," supports or allows an Iranian tanker carrying crude oil to dock risks US sanctions.

He told reporters that if an Iranian supertanker that left Gibraltar on Sunday again heads to Syria, "we'll take every action we can consistent with those sanctions to prevent that."

Pompeo said the US doesn't want crude oil to go to Syria because it will be "off-loaded, sold, used by the Quds force, an organization that has killed countless Americans and people all across the world."

He was referring to the Islamic Revolutionary Guards Corp, which the US recently declared a terror organization.

In the 21st century, US Forces have killed hundreds of thousands in its extended global War of Terror.

Now that the government has to take the plunge about participating in a maritime mission in the Strait of Hormuz, it threatens to become a symbol of the growing gap between the US and Europe. Also in the Netherlands, prominent voices are now turning against military action under American command.

The protection of the free passage through the Strait of Hormuz - where ships have been attacked in recent months - has become the subject of geopolitical rivalry and disagreement between Western allies this summer. The American plan was welcomed in Europe, where even alternative plans emerged. The Netherlands reacted "with benevolence", but former commander of the armed forces Dick Berlijn today turned against the participation in an American mission in the Volkskrant.

According to Berlin, this seems to be primarily intended to exert "maximum pressure" on Iran, and is part of a policy that Europe, as a proponent of maintaining the nuclear agreement with Iran, strongly disagrees with. "I don't think we should participate in an operation by the Americans that we absolutely don't know what's going to happen there. What if there is a provocation and America sees that as a license to wage war on a large scale?"

Former Foreign Minister Ben Bot is also "extremely hesitant" about participating in a mission "to solve a problem created by the US itself by stepping out of the nuclear agreement." By joining the American side, the Netherlands is sending out "a strange signal". "The Americans are forcing allies into something that nobody wants at the moment."

resident Donald Trump on Wednesday called Danish Prime Minister Mette Frederiksen "nasty" and accused her of not showing respect to the U.S. after she rebuffed his interest in buying Greenland, a Danish territory.

"I thought that the prime minister's statement, that it was 'absurd,' that it was 'an absurd idea,' it was nasty, I thought it was an inappropriate statement," Trump told reporters before departing the White House for a speech to a veterans group in Kentucky. "All she had to do is say 'no, we wouldn't be interested, but we can't treat the United States of America the way they treated us under President Obama.'"
