Israel's IDF Gaza Bombing in Dutch Court

by Oui Wed Dec 8th, 2021 at 10:02:35 AM EST

A pivotal year 2014 where the Dutch can hold up human rights, a nation where the Carnegie Peace Institute, International Court of Justice, and the International Criminal Court (ICC) is hosted. Upholding Universal Human Rights ...

An excellent lawyer Liesbeth Zegveld is pleading the case in the Appeals Court.

[Update-1]

Responding to the Dutch court decision while on a tour of the Gaza border, Benny Gantz said he was proud of his command of the Israeli military, which he said "adheres to values and human rights" and observes international law "with a real goal to protect the citizens of Israel and allow them to live in peace and calm."

Roy Schondorf, a deputy Israeli attorney general, welcomed the ruling.

"The appeals court recognized their immunity from civil prosecution for anti-terror activities in the framework of operation `protective edge.' This is a very important legal precedent that protects all IDF (Israeli military) commanders from similar attempts," Schondorf tweeted.

The lower court also said Ziada was free to sue the men in Israel. At hearings in 2019, Ziada rejected the idea that he has access to justice in Israel as "farcical as well as vicious."

Ziada told an earlier hearing that he lost his mother, three brothers, a sister-in-law and a 12-year-old nephew in the airstrike.

END OF UPDATE

Meanwhile in the Occupied Territories of Palestine:

In 2020, Israel demolished 273 Palestinian homes making 1006 Palestinians, including 519 children, homeless. Moreover, Israel destroyed 458 important non-residential structures, including water pipes and cisterns and power grids. As reported by B'Tselem,  2020 was one of the highest records for demolitions in three years.

As part of the Oslo Accords, the West Bank was divided into the following areas: Area A (17%), Area B (23%), and Area C (60%).  Area C is where most of the demolitions have taken place because it is under complete Israeli military control.  The Israeli military controls every aspect of Palestinian lives, including planning and infrastructure, denying Palestinians the right to build anything from an animal pen to a house, and diminishing Palestinians' freedom and dignity.

Meanwhile, Israeli settlements continue to expand exponentially across the West Bank. The South Hebron Hills receives the highest number of demolitions.

State Business: Israel's misappropriation of land in the West Bank through settler violence | Human Rights NGO B'Tselem |

Settler violence against Palestinians is a daily matter in the West Bank. Instead of taking preventive action, the Israeli authorities aid and abet the settlers in harming Palestinians and using their land. The report shows how settler violence is an unofficial arm of the state violence Israel uses to drive Palestinians off their land. By downplaying it as a fringe phenomenon while keeping up a pretense of law enforcement, Israel enjoys the best of both worlds: maintaining room for "plausible deniability" while taking over more West Bank land.

PM Rutte and failed memory on so many occasions, excellent legal defense in court ...

There was no cover up over Iraq casualties, prime minister tells MPs | Dutch News - Nov. 28, 2019 |

During a stormy debate on Wednesday night, Rutte was asked repeatedly what he knew about the bombing and when but only 48 out of 150 MPs voted in favour of an SP motion of no-confidence.

Former defence minister Jeanine Hennis has said she 'probably' told the prime minister about the Dutch involvement in the raid, but he says he cannot remember the conversation.

'I cannot force you to believe me,' Rutte said. 'It is a question of trust. But I cannot fake memories I do not have.'

Both Rutte and current defence minister Ank van Bijleveld told MPs that the cabinet would be more transparent about future military missions and that new rules have been drawn up for briefing parliament.

Decades Israel has abused Palestinians and International Law ... not abiding by UN Security Council Resolutions --- permanently filing complaints while wasting opportunities for peace.
