Decision Will Require Congress to Approve CO2 Regs
In a long-awaited decision with far-reaching consequences, a US Supreme Court ruling this week blocked an attempt by the Obama-era Environmental Protection Agency to impose expansive regulations on the electric sector that would have effectively banned coal-fired power generation.
The court's decision dates back to the EPA's proposed Clean Power Plan issued in 2015, the implementation of which was quickly halted when the Supreme Court issued a stay, the first time the court had ever done so prior to review by a federal appeals court.
The stay was issued in response to a lawsuit against the Clean Power Plan filed by a group of states and industry groups that included North Dakota. They argued the EPA plan exceeded its authority under the Clean Air Act and violated states’ rights to regulate electrical power.
The final version of the regulation would have mandated that North Dakota reduce carbon dioxide emissions from its electric generation facilities by 45 percent, which would have effectively required the shutdown of several coal-fired power plants.
State and industry leaders applauded the court's ruling. Gov. Doug Burgum said the decision affirms the state’s role as an equal partner to the federal government in regulating emissions.
