Situation in Ukraine ICC-01/22

Ukraine is not a State Party to the Rome Statute, but it has twice exercised its prerogatives to accept the Court's jurisdiction over alleged crimes under the Rome Statute occurring on its territory, pursuant to article 12(3) of the Statute. The first declaration lodged by the Government of Ukraine accepted ICC jurisdiction with respect to alleged crimes committed on Ukrainian territory from 21 November 2013 to 22 February 2014 [see end date … first procedure not the Maidan or Odessa massacre of civilians … Kyiv handled those two events??]. The second declaration extended this time period on an open-ended basis to encompass ongoing alleged crimes committed throughout the territory of Ukraine from 20 February 2014 onwards.

On 28 February 2022, the ICC Prosecutor announced  he would seek authorisation to open an investigation into the Situation in Ukraine, on the basis of the Office's earlier conclusions arising from its preliminary examination, and encompassing any new alleged crimes falling within the jurisdiction of the Court.

Ukraine unveils plan for recaptured Crimea - but West 'reluctant' to help | France24 - Apr 4, 2023 |

The most telling detail in a 12-point plan outlined by Oleksiy Danilov, secretary of Ukraine's National Security and Defence Council, concerned Sevastopol - Russia's main port on the Black Sea for the past 200 years. In this plan for Crimea's "de-occupation", Danilov said "the so-called 'city of Russian glory' is to be renamed Object 6".

Danilov also promised tough action against Ukrainians in Crimea deemed to be collaborators with the Russian enemy: "In addition to prosecuting perpetrators for collaboration and high treason, a lustration mechanism is under development that will determine the level of responsibility and degree of involvement of Crimean residents in supporting occupation administration activities," the report said.

Ukrainian President Volodymyr Zelensky said in August that "everything started with Crimea and will end with it", referring to Russia's annexation of the peninsula in 2014. Asking for more Western arms, Zelensky said at the Davos summit in Switzerland in January that "our objective is to liberate all of our territories" and "Crimea is our land".

Long-range weapons necessary

Rhetoric from the Biden administration's hawkish faction emboldened Kyiv. US Under Secretary of State for Political Affairs Victoria Nuland said in February that "Ukraine is not going to be safe unless Crimea is at a minimum demilitarised".

But just days before, Nuland's boss Secretary of State Antony Blinken implied scepticisme about Ukraine retaking Crimea on a private call with experts leaked to the press - saying Crimea is a "red line" for Russian President Vladimir Putin.
While stressing that decisions about the war are Ukraine's to take, Blinken told a congressional committee in March that Kyiv may want to think about using diplomacy instead of military offensives in trying to take back some parts of its territory.

Focus on the last in a stream of "provocation" misses the point of war as ICONIC patents are intended to do. Predicting "retribution" directed by NATO's appointed figurehead at this point is as childish as ignoring the permanence of objects. For example, Gen. Danilov's declaration on behalf of the President of Ukraine to purify, to immolate, more Ukrain "citizens." It is one and the same that animated the Kremlin's R2P Russian-speaking "residents" in Ukraine—years before the drones o'er Moscow sank with the Moskva. This is a gift for anyone still enthralled with NATO's concept of "collective defence for its Allies" embodied by the lethal sovereignty of Ukraine.

Worse than I expected as the war in Ukraine was conflated with Nazi war crimes.

Zelensky got applause from Dutch Parliament, King Alexander and especially Mark Rutte and Ollongren of Defense ... bloody madness when commemorating the tens of millions who died at the hands of Nazi fascism. Also Ukrainian death camps and killing fields of Babi Yar in Kiev.


Specifically mentioning he is a Jew ... so is Netanyahu and the war crimes and crimes against humanity. Genocide has no ethnicity ... can happen everywhere and anytime. ☮️

    Russia conducted a layered, multi-vectored attack which came from various sides including north, east, and south, which included both Geran drones as screening cover, Kalibr missiles, Kh-101s, and finally the Kinzhals.     EU's Borrell tells Putin to choose between having guns or butter for people | DW News - July 30, 2022 |

    "The war machine is not only working with money, it is also working with technology," the European Union's foreign policy chief Josep Borrell told DW when speaking about sanctions imposed against Russia.

    According to Borrell, Russian tanks rely on Western components.

    Greek businessman suspected of spying for Russia arrested in Paris

    Bogonikolos, of Athens, Greece, was arrested in Paris last week and faces extradition to the U.S., a Justice Department statement said.

    The case against Bogonikolos portrays him as a man with access to sophisticated military technology, which he smuggled to blacklisted companies tied to Russia's intelligence services.

    "As alleged, while ostensibly operating as a defense contractor for NATO and other ally countries, the defendant and his Aratos Group were double-dealing, helping to fuel Russia's war effort and their development of next generation weapons," U.S. attorney Breon Peace said in a statement.

    Conglomeration of countries extending from Eastern Europe to Eastern Asia. Prior to World War II, about 3 million Jews lived in the Soviet Union. About one-million of them were murdered in the Holocaust.

    This pact allowed the Germans free reign to invade Poland without Soviet intervention. In exchange, the Soviets were given the eastern parts of Poland and the Baltic countries of Latvia, Lithuania, and Estonia. Over the next year the Soviets also annexed Bessarabia and Bukovina, which had been under Romanian rule since World War I. Altogether, these new territories had a Jewish population of about 2 million. Additionally, about 250,000--300,000 Jewish refugees from German-occupied western Poland had fled to the Soviet Union after the war broke out. Jewish populations in these territories did not live under the best conditions but at this point, they were spared the systematic extermination suffered by Jews under the Germans.

    The relatively good status of Jews in the Soviet Union did not last long. In mid-1941 the Germans decided to betray their pact with the Soviets and secretly planned to attack the Soviet Union in Operation "Barbarossa." In preparation for their invasion, the Nazis ordered the extermination of all Jews living in those areas annexed by the Soviet Union in 1939--1940. The Germans attacked on June 22, 1941.

    After the invasion, more than 5 million Jews came under Nazi rule, constituting over half of Europe's Jewish population. Einsatzgruppen followed the advancing army and with assistance from local collaborators and various police and regular army (Wehrmacht) units, they quickly massacred most of the Jews of the Baltic States, Belorussia, and the Ukraine by shooting into open pits. The remaining Jews were put into ghettos, and most were murdered within 12--18 months.

    Most deaths followed after the German Blitzkrieg, invasion and occupation of third countries. After Operation Barbarossa, the Jewish populations in Poland and Galicia (90% - 3 million), Baltic states (200,000), Western Ukraine ( up to one million) and Hungary (565,000) were killed within days or send to death camps.
