BREAKING: Israel Expects ICC Arrest Warrants Next Month Netanyahu and IDF senior commanders face arrest for war crimes | Tikun Olam |

Israeli media report that the cabinet has met in emergency session regarding plans by the ICC to issue arrest warrants against its senior political and military leadership.  It has not yet been reported by global media. Those to be named will be Prime Minister Netanyahu and senior IDF commanders responsible for the Gaza genocide.  The warrants would be filed sometime next month according to 972 Magazine's Yuval Avraham. (see tweet above)

...Ministers and...government legal experts held an 'emergency discussion" at the Prime Minister's Office...regarding how to fend off the feared imminent issuing of such arrest warrants.

The meeting was convened after information reached Jerusalem indicating that such warrants could be issued in the near future, the report says.

Netanyahu also raised the concern in his meetings this week with Britain's Foreign Secretary David Cameron and Germany's Foreign Minister Annalena Baerbock.

At Tuesday's discussion...Foreign Minister Israel Katz, Justice Minister Yariv Levin and Strategic Affairs Minister Ron Dermer...decided that Israel would also seek assistance in other influential international diplomatic circles to try to thwart the effort, the report says.

It is hardly a surprise that Germany would protect Israeli leaders with blood-stained hands.  The Nazis committed genocide while denying it; just as Israel is committing genocide and denying it, while Germany is colludes with the campaign of denial.  Not to mention it has broken up a conference at which Israeli war crimes would be documented.  It arrested and imprisoned Palestinian and even Jewish activist protesting there against this genocide.

This is a long-awaited decision by the ICC.  Many Palestine supporters had criticized the Court for years of delay after it announced in 2014 that it would begin an inquiry into war crimes during Operation Protective Edge (2014).  Khan made a single visit to the Rafah crossing and made vague comments indicating Israel might be held responsible for its actions in Gaza.  He made no effort to visit Gaza itself to see conditions first-hand.  Israel would have prohibited entry anyway, to thwart his efforts to hold it accountable.  He did, of course, visit Israel.

Channel 13 reports that when the Baerbock offered to show Netanyahu and Strategic Affairs Minister Ron Dermer "photos of hungry [Gazan] children on my phone," Netanyahu told the German official, "Come and see the pictures of the markets in Gaza, the beaches in Gaza, there's no famine there."

According to Channel 12 news, three ministers and several government legal experts held an "emergency discussion" at the Prime Minister's Office on Tuesday about how to fend off the potential warrants.

The meeting was convened after Jerusalem received messages indicating that such warrants could be issued in the near future, the report said, without citing any sources.

Foreign Minister Israel Katz's office confirmed to The Times of Israel that the meeting took place and said there were also discussions about the possibility that warrants could be issued against IDF officers.

Netanyahu raised the matter in his meetings this week with Britain's Foreign Secretary David Cameron and Germany's Foreign Minister Annalena Baerbock, and sought their help, the TV report said.

Direct state-to-state strikes between Israel and Iran are "over," says regional intelligence source

A regional intelligence source with knowledge of Iran's potential reaction to Friday's strike, which was carried out by Israel according to a US official, said that direct state-to-state strikes between the two enemies were "over."

The Hebrew Yedioth Ahronoth newspaper said yesterday that the issuance of arrest warrants against top Israeli officials by the International Criminal Court (ICC) will be a very strong blow to the state of Israel.

"The 124 countries recognised by the Hague Court will be obligated to arrest Prime Minister Benjamin Netanyahu, Defence Minister Yoav Galant, Army Chief of Staff Herzi Halevi, and any person against whom an arrest warrant is issued whenever he/she arrives on their territory," the paper explained, adding that this means that the Israeli leadership will not be able to leave the country, except perhaps to visit dictatorship countries or countries that pledge in writing in advance not to arrest that senior Israeli official.

It stressed that the matter is personal and will remain pending even if that politician resigns from politics.

According to the paper, the arrest warrants would also be a fatal blow to Netanyahu, who considers himself a statesman who loves to travel around the world, as this arrest warrant will keep him in Israel until further notice.

Israel, it added, will not cooperate with the ICC if arrest warrants are issued, and will not recognise any international court that seeks to judge it, noting that Israel may act secretly to persuade the ICC top prosecutor to cancel the arrest warrant requests.

While ICC top prosecutor, Karim Khan, is the one who requests arrest warrants be issued, the orders are given by the three judges of the pre-trial panel that discusses the case, represented by the president of the panel, Judge Lulia Motoc from Romania, and headed by Judge Flores Liera from Mexico and Reine Alapini from Benin.

After Khan submits such a request, he must provide evidence and the court must make a reasoned decision, the paper said, pointing out that such a step does not take place overnight, and according to estimates, it may take a month.

Concerns about arrests' impact on Jews in Diaspora

The Media Line interviewed Anne Herzberg, legal adviser at NGO Monitor, about the potential ICC arrest warrants and their impact on the Israel-Hamas conflict and hostage negotiations.

Herzberg noted that while Israel considers ICC developments, they do not dictate the country's military strategy. "Rafah has been debated and planned for many months. It's the last holdout for Hamas and essential to victory in this war.

Herzberg believes that ICC arrest warrants could escalate global protests and pressure allies like the US and UK to push Israel.

She warned that indictments against only Israelis would be troubling, particularly given the events of October 7 and the hostage situation. "Everything we've been hearing is related to indictments of Israelis, not Palestinians. I guess we'll have to see what happens. Still, if it turns out that the indictments are only against Israelis, that would be egregious and outrageous," she asserted.

Herzberg stated that if ICC prosecutor Karim Khan issues arrest warrants solely against Israelis, it will reveal much about the court's role in international conflicts, especially in anti-terrorism efforts.

She noted that the US is not an ICC member and former President Donald Trump sanctioned the prosecutor and officials for opposing US interests. She speculated that while the Biden Administration wouldn't repeat this, they might engage in frank discussions with the prosecutor.

"The US's best leverage, of course, is funding. They can say they're not going to fund and not cooperate. Last week, the ICC issued a paper on the principle of complementarity, which is one of the governing principles of the court. If a country is investigating charges, the ICC will not step in, but in the case of Israel, they repeatedly violated that principle. In that document, they were asking for money to set up field offices, presumably on the Egyptian border or in Gaza. So that's one thing that could be withheld. Not giving the funds to open these offices and not giving the court as much support as they could. These are some ways Israel's allied countries could exercise leverage," she explained.

Herzberg criticized the ICC's cases, as well as the case before the and the International Court of Justice, as a form of political warfare. "Every war has its kinetic action, military action, and information warfare. This is clearly part of information warfare." She warned ICC prosecutor Khan against falling into the trap of pursuing actions that could reinforce biases.

Herzberg also fears that the issuance of ICC arrest warrants against Israeli leaders will empower the current anti-Israel and antisemitic protesters even more. "Should the ICC go forward, I think it will amp these [anti-Israel protests] up to levels we have never seen. It will place Jews in the Diaspora in even more danger. One of the precepts of the ICC is the interests of justice, so Karim Khan should take a look at the interests of justice when he's going forward and how his acts will be emboldening Iran, Hezbollah, the Houthis, Hamas, hurting the hostages, and contributing to historical levels of antisemitism not seen since World War II," she concluded.
