Democracy a Machinery Hiding Conspiracy of Elites

2019 World Justice Project award acceptance speech by Adam Bodnar

This distinction is an important recognition for all rule of law defenders in Poland - the Ombudsman is just one of them - said Dr Adam Bodnar in The Hague

30 April 2019

Karol Modzelewski was a historian and dissident, imprisoned for 8 years for his political beliefs during Communist times.

He was always fighting for democratic Poland. But - he was not satisfied with changes after 1989. He claimed that Poland regained freedom, but it forgot about equality and brotherhood.

Poland over 25 years of democratic transformation has reached the stage when liberal democracy stopped to meet expectations of the whole society.

In his opinion vulnerable and neglected people started to regard democracy as a machinery which is hiding the conspiracy of elites. One of the reasons was not delivering justice to all of them.

Such distrust of a huge part of the Polish society (approximately 1/3) opened the way for populist narrative and attack on democratic and rule of law institutions in 2015.

This attack is still ongoing. The ruling party is trying to create - as Karol Modzelewski framed it - "police state" with different instruments allowing to stay in power and controlling citizens.

Currently the judicial independence is at stake.

As the Ombudsman I try to do everything what is possible in order to save rule of law in my country. I know that rule of law is not a zero-one game. Rule of Law Index by World Justice Project is a great tool to explain to the public opinion that the change is not happening overnight.

States may slide into authoritarian rule as a result of series of actions, which are not even noticeable by citizens on a daily basis. But after a few years you are waking up in a completely different country. That is the reason why you have to be cautious almost every day.

But you must also respond to needs of society, that rule of law guarantees should be of value for everybody. My office tries to show its importance to citizens by regular visits in different regions of Poland, by litigation of numerous cases, by submission of hundreds of interventions and recommendations.

From MarekNYC diary in 2005 ...

Poland has a new government

I take it that Radek Sikorski is the Radek Sikorski who is/was Secretary General of the New Atlantic Initiative? Of which John Bolton and Donald Rumsfeld (for example) are advisory board members (albeit 'suspended while on Government service')?

Does this have interesting implications for the direction of Polish Politics?

[...]

The one and the same Radek Sikorski. But the implications are likely to be minor if any. The previous post communist government was strongly Atlanticist and supportive of the Bush administration. Law and Justice is even more pro Bush, so Sikorski's appointment is more a reflection of the new government's views than something that will influence its policy in a pro-Bush direction.

Interview with Radek Sikorski on Bush's Relationship with European Allies | AEI - 24 Jan 2003 |

So, Mr. Sikorski, a lot of anger in Europe -- well, particularly Germany and France -- when Don Rumsfeld said oh, don't worry about them, they're Old Europe. We're going to be looking to Poland. And Latvia. And Italy. And Spain. As our new European allies.

What is it that's got the Germans and the French so upset?

America succeeded to split Europe, pushed former Soviet satellite states in a straightjacket to support the illegal wars, especially the Iraq War in March 2003, made several states complicit in torture, rendition and assassinations. All with impunity as the bully voices international law, Geneva Convention and Human Rights law ... are for suckers and losers 😡 ‼️

After four desastreus years of the Joker Trump administration, Joe Biden and Antony Blinken glued East and West, New and Old, together in a war narrative, anti-Putin, anti-Communism, and  carried Russophobia forward as legacy of the loss in 2016 of HRC, the intelligence community started the operation of lies, disinformation and indoctrination ... thank you Big Tech in Silicon Valley, AT&T, NSA, CIA for your collective support of directing news and essential censorship. All signs of FASCISM.

A New Way Forward for Trans-Atlantic Security Relations

U.S. opposition to EU defense efforts since the 1990s has been a strategic mistake that has undermined both the EU and NATO. It's time for a new U.S. approach that encourages ambitious EU defense strategies.

Palestine and History: Macklemore v. Hillary Clinton

The reference is to Columbia University's Hamilton Hall, which students occupied briefly and renamed "Hind's Hall."

Hind Rajab was a Palestinian little girl who got into her uncle's car in northern Gaza on January 29, along with her aunt and four cousins. Under the shockingly inhumane Israeli rules of engagement, unlike anything in any civilized democracy, the car was fair game just because it was in motion out in the open.

Israeli pilots and tank and artillery commanders appear to make no effort at all to avoid killing civilians, explaining why they have murdered over 40,000 people from the air (over 34,000 confirmed and thousands more under the rubble). The car was hit and everyone was killed but the five-year-old Hind. Her cousin had tried calling the Red Crescent rescuers but was herself shot to death. Hind called them back herself, in an incredible feat for a wounded child surrounded by the corpses of her loved ones.
