Joe to Bibi on Rafah: 'Bring It On'

by Oui Wed May 8th, 2024 at 10:40:27 AM EST

The Final Solution

ICJ in The Hague: Genocide!
White House: No this is not genocide, but defense of existential threat.

ICC in the Hague: Arrest warrants for Netanyahu and his war criminals:
US Congress and White House: We can make life miserable for individuals, lead prosecutor and colleagues doing the investigation of crimes in the Gaza Strip and the West Bank. No, Palestine is not a state and has no standing in the court of justice. NWO

Joe Biden and Bibi Netanyahu are two of a kind ... inseparable twins of evil.

Four years of disaster for the Jewish State started under "friend" Trump in the White House and son-in-law Jared Kushner, relative of Netanyahu.

Inside the Biden administration sham to convince the world Netanyahu wants a ceasefire | Mondoweiss |

Antony Blinken claims that Hamas is blocking a ceasefire in Gaza, but it is Israel which has vowed to invade Rafah regardless of an agreement and is absolutely unwilling to declare an end to its genocidal operation.

The shameless cover the United States has extended for Israel has taken on new dimensions of theatrics as pressure grows for Joe Biden to put a stop to the genocidal slaughter that has been going on in Gaza for seven months now.

That [Kabuki] theater has often veered into the absurd, as, just to cite one example, when the President has complained about Israel not allowing humanitarian aid in to Gaza--an unambiguous war crime under international law--only to have  administration spokespeople assert that they have "no evidence" that Israel has broken international law.

U.S.: Israeli seizure of Rafah crossing does not defy Biden warning

John Kirby, spokesman for the White House National Security Council, also said the U.S. is optimistic Israel and Hamas can still reach an agreement on a temporary cease-fire.

Israel’s 401st Brigade took “operational control” of the Gaza side of the Rafah crossing early Tuesday, the military said.

The action came a day after Biden urged Israeli Prime Minister Benjamin Netanyahu in a phone call not to launch a large military offensive in Rafah, where more than 1 million Palestinians are sheltering.

Israeli forces have seized control of the Gaza side of the Rafah border crossing, a place where some aid had been making its way to civilians. Tanks moved in on the area just hours after Hamas said it accepted the terms of a Qatari-Egyptian proposed cease-fire plan. Israel ultimately rejected the proposal, saying the deal didn't meet its core demands?

What a twenty-five-year-old memo by Daniel Ellsberg says about the past failures of Lyndon Johnson and the current horrors of Benjamin Netanyahu.

The conversion of my friend Ellsberg, who died last June of cancer, from avid supporter of and adviser on the Vietnam War to perhaps its most important critic is well known. One of Dan's major obsessions was with American leadership, specifically with the perversity of President Lyndon Johnson continuing to fight a war that many of his closest advisers knew could not be won.

I thought of Dan after learning here in Washington that Israel's--make that Benjamin Netanyahu's--latest incursion into Rafah would be an all-out `go' unless the Hamas negotiating team, now in Cairo, provides proof of the well-being of the thirty-three Israeli hostages said to be in its control. Without such proof, I was told by a senior American official, it will be "end game on."

This Generation's Vietnam: Students are Protesting Israeli Genocide, meeting Media and Political Vilification | Informed Comment |

Opposition to the Vietnam war on college campuses initially took the form of an attack on  universities' complicity with the murderous assault in Vietnam. The U.S. committed war crimes on an industrial scale. Along with the use of carpet bombing, the US dropped napalm -- liquid fire that clung to human bodies and melted flesh. The use of toxic herbicides, such as Agent Orange, defoliated over 7 million acres of forest while destroying crops. This ecocide resulted in 400,000 deaths caused by a range of cancers and 500,000 children born with serious birth defects.

The  producer of napalm and  Agent Orange was Dow Chemical When the company came to the University of Wisconsin-Madison campus, students seized the campus building where Dow was recruiting and demanded the University stop cooperating with Dow. Dozens of students were beaten bloody as Madison police brutally ejected and arrested them. Nevertheless, the boldness of the demonstration and the repressive violence of the police politicized thousands of previously apathetic students and helped to transform the Madison campus into one of the nation's leading anti-war communities.

As one of the earliest examples of students stopping their University's complicity in war-making, the occupation of the UW building became a protest model utilized since then, most famously at Columbia University in 1968 and now in 2024. The current protest encampments -- that occupy a small section of the campus -- echo those building take-overs while also evoking the image of the squalid tent camps in Rafah where homeless Palestinians have been forced to live.

Just as the anti-Vietnam war peace movement was charged with being terrorist apologists and Communist sympathizers, the current student movement against Israel's genocide is smeared as Hamas supporters and antisemitic oppressors.

Biden doesn't care about Jews unless they share his support for Zionism | Mondoweiss |

On May 6th, 2024, US President Joe Biden, in a speech on antisemitism, said, "To the Jewish community, I want you to know, I see your hurt, your fear, your pain. Let me reassure you. As your President, you are not alone. You belong. You always have and you always will."

I am a Jewish American but when Biden addressed "the Jewish community," he was not speaking to me. When Biden said, "you are not alone, you belong," he was not reassuring me. I am not part of Biden's imagined monolithic Jewish community and he made that very clear as he continued: "My commitment to the safety of the Jewish people, the security of Israel, and it's right to exist as an independent Jewish state is ironclad."

For Biden, the only good Jews are Zionists - those who support Israel and its settler colonial project. But what about the rest of us? We Jews who reject a conflation of Judaism and Zionism? We Jews who say never again and mean never again for everyone? We Jews who are calling for a free Palestine and an end to Israel's occupation?

I am an anti-Zionist Jew. This is the core of my Jewish identity. Such clarity, shared by so many, has been demonized around the world. Nowhere is this more apparent than in the United States, where our government continues to fund Israel's genocide in Palestine, where American media outlets reproduce Israeli propaganda and call it news where university administrators silence all dissent under the guise of antisemitism. If you are paying attention, much of this dissent is coming from anti-Zionist Jews but this identity and ethical political position has been framed as impossible by those in power, who are invested in preserving racism, imperialism, and settler colonial violence by flattening a heterogenous religious and ethnic group into a Zionist monolith.

Right now, Zionists like Biden are weaponizing antisemitism to silence anti-Zionist Jews like me. Biden is not alone. I am a tenured college professor who teaches and writes about Palestine. Because of this work, I have received death threats, hateful emails, and calls from students, colleagues, and alumni for me to be fired. Almost all of these attacks have come from Jews who identify as Zionists and see me as a threat. In January 2024, my college caved to this pressure and placed me on administrative leave. I have been removed from my classroom, barred from campus, and locked out of my college email account. I may soon lose my job. All because the comfort of Zionist students has been privileged over the lives of Palestinians, who are being slaughtered by the tens of thousands, starved by the hundreds of thousands, and displaced by the millions.

Most remarkable feature of Biden's Holocaust speech was how little his words seemed to matter, they disappeared in the wind almost as soon as they were uttered | Daily Mail |

What Biden's Holocaust Speech Ignored | The Nation |

The president's ahistorical account of Gaza failed to acknowledge the discomfiting truth that brutalized communities can visit the same traumas on others.

Indeed, Trump's repellant gloss on Charlottesville wound up having a grim salience after the proceedings at the Visitor Center wound down. It turned out that, as the assembled speakers were playing up the threat of antisemitic violence on US campuses, a hard-line Zionist protester at Columbia drove his car into a group of anti-war protesters.

It further turned out that the accused attacker was Reuven Kahane--a grandcousin of Meir Kahane, the militant, racist founder of the Jewish Defense League and the Israeli Kach Party who now is a spiritual mascot of Israel's extreme religious right. It's difficult to conjure a more instructive instance of what Jewish philosopher Walter Benjamin--who'd committed suicide while on the run from the Nazis--used to call the cunning of history: the notion that the solemn course of events often switches abruptly back against our efforts to ascribe our own higher intentions to it. It's a historical lesson that we all need to learn--and no one more so than the assembled political leaders holding forth on intolerance and violence at the Capitol Visitor Center.

Will the ICC issue arrest warrants for Israeli officials?

In 2021, the ICC opened a war crimes investigation into Israel's actions in the occupied Palestinian territory since 2014, including the West Bank, East Jerusalem, and Gaza.

Israel's war in Gaza

Law experts and human rights groups have repeatedly claimed that Israel's devastating on Gaza is breaching international law. Since it began in October, over 34,400 Palestinians have been killed, including over 14,000 children, while most of the blockaded Palestinian territory's 2.3 million people have been forcibly displaced.

Amid intensive bombing campaigns that have left Gaza in ruins and severe shortages of food, water, fuel, and medicine, there have been repeated warnings that famine is imminent, while disease has spread.

Israel, like the US, is not a signatory to the Rome Statue which established the ICC and "does not recognise its authority". [Nonsense, supports the ICC in most cases brought before the Court ... see the ICTY predecessor and in 2023 the decision on Russia and its leader Putin for transgressions in the Ukraine conflict.]

Although Israel has not signed up to the ICC, the State of Palestine - a non-member observer state at the UN - became a signatory in 2015 thus granting the court jurisdiction to investigate war crimes perpetrated by members of the Israeli government in Gaza and the West Bank, even though they are not citizens of an ICC state.

The tribunal has the mandate not only to investigate but also to prosecute individuals allegedly responsible for war crimes, crimes against humanity, genocide, and the crime of aggression. The court becomes involved when states are unable or unwilling to prosecute crimes on their territory.

thecradle | Israel to hand over Rafah crossing to private US firm- reports,8 May
Israel will grant control of the Rafah border crossing to a private US security company, Haaretz newspaper reported on 7 May.

The US, Egypt, and Israel have agreed "that a private American security company will assume management of the crossing after the IDF concludes its operation." Discussions between the three sides have been ongoing. Israel has committed to the US and Egypt that it will restrict its operation in Rafah, Gaza's southernmost city. Tel Aviv reportedly made it clear during talks that the operation at the Rafah crossing aims to pressure Hamas in ceasefire talks and diminish the crossing's image as a "symbol of Hamas' power."
[...]
"As part of Israel's efforts to win agreement for a Rafah operation, negotiations have been underway with a private company [PMC] in the US that specializes in assisting armies and governments around the world engaged in military conflicts," the Haaretz report adds. The company, which employs veterans of elite US military units, has been active in several African and West Asian nations, guarding sites such as oil fields, bases, and border crossings.
[...]
The White House and a State Department spokesman said [?] on 8 May that they are unaware of any such plans. Several Palestinian resistance factions said in a joint statement on Wednesday

Palestinian factions: any form of guardianship of the Rafah crossing will be considered an occupation
In this context, the Arab League called on all Arab and Islamic countries, foremost of which is the Republic of Egypt, with its "weight at the International and regional level," to reject any plans and attempts that affect the Palestinian - Egyptian sovereignty at the Rafah crossing.
that they refuse any attempt to "impose any form of [foreign] guardianship of the Rafah crossing," adding that they consider this a "form of occupation."
[...]
in re: Independent.co.uk reporting statements attributed to MILLER
"It is not our assessment that a major military operation has begun," State Department spokesman Matthew Miller added at his own press briefing.
[...]
"Israel's occupation of the Rafah border crossing has a legitimate goal of preventing Hamas from taking control of the crossing," said Miller.
and KIRBY
Mr Kirby, questioned by reporters sat his briefing on Tuesday, denied knowledge of this: "I know nothing about your (question)." Miller too denied knowing about those reported plans.
First, the last published MILLER briefing was May 6, 2024. None of the Independent quotes purporting to confirm Israeli intention to transfer either Rafah, Erez, or Kerem Shalom crossings to PMC patrol are not published therein. However, buried in mendacious reviews of "a proposal" accepted by Hamas, Israel's "full-scale" or "limited invasion of Rafa", and "legitimate questions" MILLER deflects unstated questions about US boots-on-ground taboo.
I'm about to answer, Kylie. So there are proposals that we have put on the table—and this is why I'm not going to talk about some of this publicly—there are proposals that we have put on the table to the Israeli Government that we have discussed with them, that we think would be a much more limited, much more targeted, much more effective way of achieving their legitimate military—their legitimate military objectives, which is taking on the Hamas battalions that are remaining in Rafah. Those look very different than the types of operations that we have seen proposed publicly by the Israeli Government, and I think I'll leave it at that.
And "our assessment" refers to the NSM-20 report which the White House did not deliver 8 May. Either Independent's 7 May file infers with hindsight or Independent divulges off-record remarks. Which is par for British uh journalism.

Similarly, the Independent does not accurately record KIRBY-content. To be sure, gleening an iota of intelligence from the avuncular Admiral's empty Schlitz glass, 6 May, is a futile task. Kirby did utter preposterous remarks, not least of which "The U.N. has not declared a famine in Gaza writ large", getting "ahead of operations that haven't happened. I don't want to speak for the Israeli military", "All I know is we got a response. Bill Burns is looking at that response," and "All I can say is we've been very direct and very consistent in our views of concerns about operations in Rafah."

The salient point of US-Israel "legitimate military objectives" is this.

Q But the U.S. backs Israel's intention to eliminate Hamas?
KIRBY: We, of course, back their right and responsibility to go after the Hamas threat, to eliminate that threat.
And had an Independent inmate in the White House press pool 7 May had presence of mind to interrupt Ms Jean-Pierre's affected shock by Hamas' response to Israeli generosity
Q Why isn't—why—why can't the U.S. just say declaratively from the White House podium that the U.S. was not doing any side deals that Israel didn't know about?
JEAN-PIERRE: A side deal? There's—no, absolutely not. I didn't know that was the question.  I can say absolutely not, no. There was no side deal.
Q So, what Hamas accepted yesterday is not a proposal the U.S. had ever heard before Hamas presented it?
JEAN-PIERRE: Look, throughout this process—here's what I can say: American diplomats have been engaged with our Israeli counterparts on this throughout this process. There was no side deal. I didn't realize that was the question you were asking me. Absolutely not.
that person could have furnished Haaretz's invisible lede story that day with a halter.

QUESTION: Right. Okay. So can you explain to us what the—what the practical impact, at least for the State Department, is of the President's comments last night about arms shipments to—arms transfers to Israel and whether or not this plays into the NSM report that I guess is not coming today, and maybe tomorrow?
MILLER: So let me speak first with the NSM report. It doesn't have any practical impact on the NSM report. The NSM report is a backwards-looking report where we're looking at a number of things over the past—conduct from last year and then up to when we send the report, and it doesn't have any impact either on the content of the report or the timing of that report, which won't be today but, again, I expect in the very near future. It's just a matter of days that we'll be able to get that report up to the Hill.
vanhollen.senate.gov | Van Hollen Statement on Administration's NSM-20 Report, 10 May
Simply put, while this is a step forward, this report does not meet the requirements of NSM-20. It also risks establishing a dangerously low bar for the permissible use of U.S. weapons and the acceptable standard for the delivery of humanitarian assistance.

Turkey seeks to join South Africa as plaintiff against Israel at ICJ | Al Monitor |

Turkey will apply to the UN International Court of Justice to be a co-plaintiff in South Africa's case against Israel, Turkish Foreign Minister Hakan Fidan said.

"I would like to announce, for the first time, that Turkey has decided to join the case filed by South Africa against Israel in the International Court of Justice," Fidan told reporters at a joint press conference with his Indonesian counterpart, Retno Marsudi, in Ankara.

"We will submit our formal application to the International Court of Justice once we finalize the legal text, putting this political decision into action," he added.

Under Article 63 of the statute, parties have "the right to intervene in the proceedings." In April, Colombia, which announced on Wednesday it was severing its diplomatic ties with Israel, formally applied to the ICJ to intervene in the case. Nicaragua did the same in January.

The Turkish foreign minister said Turkey has been collaborating with regional and other countries "that are ready to recognize" a Palestinian statehood in an effort to convince them to join the case.

Fidan met with Qatari Prime Minister Sheikh Mohammed bin Abdulrahman Al Thani, along with his Saudi and Yemeni counterparts, Saud bin Faisal Al Saud and Shaya Mohsin Zindani, respectively, on Monday in Riyadh, on the margins of a contact group gathering set up by the Organization of Islamic Cooperation (OIC) and the Arab League to discuss a cease-fire in Gaza.

The Turkish foreign minister refrained from elaborating on whether he discussed the decision with his foreign counterparts. "As Turkey, we will continue to stand by Palestine on every issue," he said.

Egypt says it will join South Africa's genocide case against Israel at ICJ | Al Jazeera |

Egypt says it will formally join the case filed by South Africa against Israel at the International Court of Justice (ICJ), which accuses Israel of violating its obligations under the Genocide Convention in its war on the Gaza Strip.

'Diplomatic blow'

Alon Liel, former director of Israel's Ministry of Foreign Affairs, told Al Jazeera that Egypt's move was an "unbelievable diplomatic blow to Israel".

"Egypt is the cornerstone of our standing in the Middle East," he said. The connections that Israel has in the Middle East and North Africa today, including with Jordan, the UAE and Morocco, are all "a result of what Egypt did 40 years ago", he said, referring to the 1979 peace treaty between the two countries.

"With Egypt joining South Africa now in The Hague, it's a real diplomatic punch. Israel would have to take it very seriously.

"Israel has to ... listen to the world - not only to the Israeli public opinion asking now for revenge.

Secretary Antony J. Blinken With Margaret Brennan of CBS's Face the Nation

QUESTION:  Good morning, Mr. Secretary.  I know military experts say Gaza is as complicated and challenging a battlefield as any modern warfare has seen.  But back in December President Biden said Israel conducted indiscriminate bombing; in February he said Israel's offensive was over the top; and then this past week he was asked on CNN about pausing the delivery of 3,500 bombs.  Here's what he said.

PRESIDENT BIDEN:  Civilians have been killed in Gaza as a consequence of those bombs and other ways in which they go after population centers.  And I made it clear that if they go into Rafah, I'm not supplying the weapons that have been used historically to deal with Rafah, to deal with the cities, to deal with that problem.

QUESTION:  Mr. Secretary, is Israel living up to international humanitarian law standards?

SECRETARY BLINKEN:  Well, first, Margaret, good morning.  The report that we put out lays out some of the concerns that we've had throughout this period when it comes to humanitarian assistance, particularly the early months after October 7th, and when it comes to the use of weapons, concerns about incidents where, given the totality of the damage that's been done to children, women, men, it was reasonable to assess that in certain instances, Israel acted in ways that are not consistent with international humanitarian law.

It's also critical to note that Israel itself has accountability processes to get at this.  There are hundreds of ongoing inquiries looking at different incidents that have taken place since October 7th.  There are criminal investigations that are going forward.  Unlike most other countries in the world, Israel has the ability, the means, and the actions to self-correct.  But we've been on this every single day.

QUESTION:  So you have been able, then, to conclude that Israel has violated U.S. laws and weapons-sharing agreements?

SECRETARY BLINKEN:  No, what we've concluded is, in the case of the use of weapons, as you said, this is an extraordinarily complex military environment in which you have an enemy, Hamas, that committed the most atrocious terrorist attacks on Israel on October 7th and then retreats to Gaza, hides behind and underneath civilians, in hospitals, schools, mosques, apartment buildings, and that makes it very difficult to determine - particularly in the midst of war - exactly what happened and to draw any final conclusions from any one incident.

So we have a number of incidents that we continue to look at to try to get the best possible assessment.  The Israelis themselves are doing the same thing.

QUESTION:  Yeah.

SECRETARY BLINKEN:  Our assessments will be ongoing.  But as I said, given the totality of what we've seen in terms of civilian suffering, in terms of children, women, men caught in this crossfire of Hamas's making who've been killed or been injured, it's reasonable to assess that in a number of instances, Israel has not acted in a manner that's consistent with international humanitarian law.
