On 20 May 2024, the ICC Prosecutor filed applications for warrants of arrest before Pre-Trial Chamber I :
- Concerning Yahya Sinwar, Mohammed Diab Ibrahim Al-Masri (Deif), and Ismail Haniyeh for war crimes and crimes against humanity allegedly committed on the territory of Israel and the State of Palestine (in the Gaza strip) from at least 7 October 2023;
- Concerning Benjamin Netanyahu and Yoav Gallant for war crimes and crimes against humanity allegedly committed on the territory of the State of Palestine (in the Gaza strip) from at least 8 October 2023.
It is now for the judges of the Pre-Trial Chamber I to decide whether the necessary standard for the issuance of warrants of arrest has been met.
The Court finding it difficult to hold Israel's war criminals to account, contrary to clear demands by the ICJ at the Carnegie Peace Palace in The Hague.
ICC set to release warrant of arrest against Israel's PM Benjamin Netanyahu
The International Court of Justice (ICJ) has ruled that Israel's settlement policy in occupied Palestinian territories is contrary to international law. In 2022, the UN General Assembly requested the court to rule on Israel's prolonged occupation, settlement and annexation of Palestinian territories including East Jerusalem. The advisory opinion predates the current conflict between Israel and Palestine. In a separate case brought by South Africa, the world court ordered Israel to halt its Rafah offensive in the Gaza Strip.
The criminal fascist state strongly condemned the ruling.

ICC Israeli arrest warrants: US, UK & Germany trying to block procedure
The UK has not issued a formal challenge to the arrest warrants yet. The former Conservative government had only managed to gain court approval to submit arguments before the July 4 UK elections, which the Conservatives lost, leaving the challenge up in the air. The ICC first gave the UK government time until July 12 to file a legal opinion. That was then extended to July 26.
The New York Times reports that Prime Minister Keir Starmer is expected to drop the previous government's objections to the ICC warrant. The International Criminal Court (ICC) is expected to issue arrest warrants for Netanyahu and Defense Minister Gallant within weeks.
"If reports that the new British government will drop its objections to the pursuit of an ICC arrest warrant for the war criminal Benjamin Netanyahu are true, that would be a welcome decision that the Biden administration should also take," said CAIR National Executive Director Nihad Awad.
