Legal experts questioned the president's response to unrest in Los Angeles, saying he appears to be laying groundwork for more expansive use of the military to suppress dissent.
President Donald Trump's order to deploy 2,000 California National Guard troops to Los Angeles appears unprecedented, relying on an unorthodox use of a law aimed at quelling serious domestic unrest or an attack on the United States by a foreign power, some legal experts said Sunday.
It marks the first time in about 60 years that an American president has taken such action without a governor's consent.
Furthermore, his executive order authorizes the Pentagon to dispatch military personnel domestically to enable federal functions and protect government property -- a chilling sign, the experts said, that Trump is prepared to send troops into other cities in response to protests.
"That is completely unprecedented under any legal authority," said Elizabeth Goitein, senior director of the Liberty and National Security Program at the Brennan Center for Justice. "The use of the military to quell civil unrest is supposed to be an absolute last resort."
Trump invoked a section of U.S. code that allows the president to bypass a governor's authority over the National Guard and call those troops into federal service when he considers it necessary to repel an invasion or suppress a rebellion, the law states. California's Democratic governor, Gavin Newsom, has sharply criticized the move, saying state and local authorities have the situation under control and accusing Trump of attempting to create a "spectacle."
Legal experts said they expect Trump's executive order to draw legal challenges.

California Attorney General Rob Bonta and California Governor Gavin Newsom today sued President Trump and Defense Secretary Hegseth in response to their orders seeking to federalize the California National Guard for 60 days under 10 U.S.C. § 12406.
In the early hours of Sunday morning, the U.S. Department of Defense, at the direction of the President, redirected hundreds of National Guard troops from San Diego to Los Angeles, without authorization from the Governor and against the wishes of local law enforcement.
In total, the Department intends to deploy 2,000 troops from across the state, an inflammatory escalation unsupported by conditions on the ground. In a lawsuit being filed today, Attorney General Bonta and Governor Newsom will ask the court to hold unlawful and set aside the President’s order federalizing the National Guard by way of a rarely used law, arguing that such action exceeds the federal government’s authority under the law and violates the Tenth Amendment.
“President Trump’s order calling federalized National Guard troops into Los Angeles – over the objections of the Governor and local law enforcement – is unnecessary and counterproductive. It’s also deeply unfair to the members of the National Guard who are hard at work every day protecting our state, preparing for and responding to emergencies, and training so that, if called, they can fight our nation’s wars,” said Attorney General Rob Bonta. “Let me be clear: There is no invasion. There is no rebellion. The President is trying to manufacture chaos and crisis on the ground for his own political ends.
Federalizing the California National Guard is an abuse of the President’s authority under the law – and not one we take lightly. We’re asking a court to put a stop to the unlawful, unprecedented order.”
